Hello everyone!

My wife filed a petition for me at USCIS New Delhi on Oct 7th, 2013 because she is considered a resident as per USCIS. The filing went fine (the staff at the New Delhi USCIS were quite courteous) but it's December 2nd, and I haven't received a NOA-1. Is this the normal waiting time? I contacted USCIS and they asked me create a profile on a portal. But wherever I call (USCIS, NVC etc) they ask for the receipt or case number, neither of which I have. Is the time more because I am filing from outside the US? When they send the NOA-1 by post, do they also intimate by email; my concern here being what if it's delivered to a wrong address? Would be glad to receive some clarity. Thanks!

11/29/2013 No useful replies from NVC, VFS. Only useful reply from New Delhi USCIS that my case was forwarded to Mumbai and they can do nothing besides this, but nothing else. No NOA, no case number. Completely in the dark and waiting...

Hmmm your petition might be just sitting at the embassy. New Delhi isn't a DCF filing is it? I know I had a friend do the same in Nigeria they were nice and sweet and took her petition. over 8 months later it was still sitting at embassy. I would inquire with embassy to see did they mail it off.

What should have been done was you mailed to Chicago Lockbox yourself. I would start calling and emailing embassy now. Hopefully its just slow slow mail.

Sounds like DCF. They got your files, but you're actually waiting for NOA2?

Not all embassies send a proper NOA1 in DCF cases (and some only email, often found in spam/junk folder).

Call New Dheli embassy back again, ask for your case number/confirm your case is queued for processing at their field office.

Dear lost_at_sea,

Yes, this is a DCF. We filed it here because my wife has been living here three years now and at the embassy, they deemed us eligible to file there. In fact, that is why we went in person to New Delhi so we could clear that issue out. If they had told us we weren't eligible, we'd have used the Chicago Lockbox. I guess like you both said, it's a case of a file just sitting there.

Yeah and if this info helps, this is the reply from New Delhi USCIS when I asked them for the next steps. I live in Mumbai and we have a consulate here. So they have forwarded the case there but have given me no case number or receipt number to inquire with. What do they mean by this email:

Dear xxxxxx:

Thank you for your inquiry.

The I-130 petition filed was processed and forwarded to American Consulate Mumbai. Please be advised that visa interviews are handled by Department of State, Consular Section. In order to obtain your case number/ appointment letter you may visit American Consulate General Mumbai website under link http://mumbai.usconsulate.gov/interview_appt_schedule.html to create your profile and forward your inquiry to their office via support-india@ustraveldocs.com.

Additionally, you may view your interview dates under their website under link http://mumbai.usconsulate.gov/ivinterview_preparation.html

Sounds like your petition was approved and they're waiting for you to book an interview, have medical etc.

I've also applied in New Dehli in person and wonder when I will receive any notice from them. I'll try calling them as well. Anyone who is facing delays like this should make a call to inquire about their case because it will push them into being more prompt.

From what I've heard, you made the right decision to file in Delhi instead of mailing it to Chicago. Mailing it out to the Chicago Lock-box is a sure way of slowing down the process.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hello lost_at_sea,

That post you gave helped a lot; it is definitely similar to my case but for me it has exceeded 2 months for any communication from their side and just like that other person I receive replies from VFS and the New Delhi USCIS that don't help at all. I'll just have to wait it out and try and prepare for the paperwork for the interview in the meanwhile.
