i just have a question about the IRS. what if my husband is unemployed year 2010?...he just started working year 2011 onward. my question is..is it ok. if we just submit to the NVC year 2011..2012? coz NVC require recent 3 years.

That's fine. You'll still have to fill out the question on the I-864 though. Just put $0.00 for 2010. You'll have to include a letter as to why he didn't file taxes (he was unemployed).

For the AOS package, you have two choices: submit just the most recent year tax information (currently 2012) or the past three years' tax information (currently 2010, 2011, 2012). So, submit the 2011 and 2012 tax transcripts as well as the letter I mentioned above.

No need to worry.

NVC doesn't send you any forms. You download this yourself on USCIS's website.

Just mention it at the interview and they'll correct the I-130. There's absolutely nothing to worry about.

Hello Saylin,

I have a question. On my approval letter it states "The above petition has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain form I-485, Application for Permanent Residence. A copy of this notice should be submitted with the application. If the person for whom you are petitioning decides to apply for a visa outside the US based on this petition, the petitioner should file form I-824, Application for an Action on Approved or Petition, to request that we send the petition to the Department of State National Visa Center (NVC).

My husband never came to the US. I applied for the I-130 alone not with I-485. Is this what everyone else is getting on their approval letter? I am worried. Should I contact USCIS? Thanks for the help!

Nope, that's not normal. Someone must have made a mistake on your case. Call up USCIS tomorrow morning. You're going to have to get it fixed and then sent to NVC. It may delay things for a bit, not sure.

Ugh! These people at USCIS can never get anything right! So mad right now! After 8 months of waiting, I finally get an approval and they messed that up too! Ugh! But I was wondering if an approved tourist visa has anything to do with it? My husband applied for a tourist visa before we got married and he got it approved 8 months after our marriage. He decided not to come since I filed for the I-130. So could that be a reason? Thanks a lot for the help!

How come it takes 8 weeks for uscis service center to ship the case to nvc? thats what the rep told me... has anyone experienced waiting this long?

Yep, it took 6 weeks to get to the NVC building and 2 more weeks to get case number assigned.

Note that our I-130 have been transferred to the field office and approved there.
