Does my foreign fiance have to have Health Insurance once he becomes a US Resident?

I think there is no penalty for a single gap in coverage of less than 3 months in a year. So you need not worry about having your fiance covered from the day he sets foot in the US. (Unless you are worried about him having a catastrophic health emergency. There are short-term plans and also I think people have posted info before about plans specifically for new immigrants.) Also the tax penalty may be lower than the cost of coverage, depending on your options. So really, I would not worry about it in terms of the new law, but rather look at it just as you would have a year ago :)

When I immigrated I was without insurance for a little while, less than a month I think.
