Hello,

I am a permanent resident. I have been legally living in the US for 5 yrs now. My relationship with my wife has not been the greatest. Anyway, we have been separated for 2 and half years now. I am thinking about filing for divorce officially. The issue is, she became very intolerant, "Racist" and mean. we have a kid together and she would only agree to divorce if i agree to having" Supervised visitation or parenting time", in other words, i can only spend time with my daughter if she is there. when i was reading the citizenship forms, i found a section that talks about being a good father and have good morals. I have been doing my best to help out financially even tho there was times that she would ignore my requests to see my kid. my question is: would me being divorced and having notes like " supervised visitation" on the papers makes look suspicious or bad person? and consequently hinder me from getting the citizenship??? Thank you

P.S: I have a very clean record. i have never been in any kind of troubles. i have been paying my taxes and everything..i was just cursed with this controlling wife.

That I-751 gives more loopholes for the immigrant to stay here than staying married yourself. With the five year wait for US citizenship, really the only concern that may be brought up is if you remarried someone from your home country that is a sign of fraud.

With visitation rights or even full custody of your child or children, immigration is not even considered, this is all up to your divorce hearing, the laws in your state, and how good your divorce attorney is. And as a father of these children you already have two strikes against you as the courts favor the mother.

States with no-fault divorce laws are the worse, especially if your spouse is chasing around with other guys and blowing your hard earned money faster than you can earn it. Whoever came up with a no-fault divorce law is an absolute. And doesn't even care about taking care of "her: kids. But battles like this can be won with sufficient proof. But a very expensive battle. Managed to get full custody of my minor children so it can be done.

Can't show any signs of anger that is not easy, because you are ready to kill that spouse, but rather concern and love for you child or children and their future. Can request a psychological exam of your spouse that can be used in a court of law for determination. And not easy to put such a strong emotional matter in the trust of others. But you have no choice.

The rest of the settlement is equally crazy, if you have a spouse that blows money like crazy, chases around, doesn't give a darn about her kids, and the only thing left is a can of beans in the house. She still gets half of it, regardless of the fact you gained full custody of your kids. A guy always gets stuck with child support payments, but rare to ever do that to a woman. Talk about sexual equality.

I love the last sentence. I don't think there such thing because the courts and even people themselves can be unfair toward both sexes. We see that mostly in divorce cases unfortunately even if the woman is at wrong. I don't have nothing against women but equality should be practiced fairly.

Don't worry about any notes on your divorce decree. Those are things that get decided by the divorce court. Get yourself a competent divorce lawyer (interview a few) and file for divorce. In the meantime, don't buy into any games your wife or ex is playing. Be mature, wait it out and take one step at a time. Don't agree to any terms until you have consulted with a lawyer. That's what they are for. Divorces with kids are NOT something you can do on your own.

With the USCIS, doesn't look very good if you married a US citizen to get here, get a divorce, then marry someone from your home country.

Getting married and having a child does show good intentions and good faith in your marriage. So should not be a problem with you.

One bargaining chip you have on your side, is your wife has to support you at 125% at the poverty wage with that 1-864, but that would be cancelled after you receive your US citizenship. Would forget about applying until all this is over.

After all, they say all is fair in love and war.
