I-864 and Poverty Guideline

 Share

Hello Friends,

I have a relative (like a brother) who sponsored me using Form I- 864 and that meets the poverty guideline so no worries I guess. However, my wife who is a US citizen she also has to file the same form I-864 for me and that will not meet the poverty guideline/level since she did not have a job since last 7 months and any much previous savings.

So what do you all think will happen now? Will my relative's sponsor take care of me even though my wife's doesn't?

In the worst case, if I fall in the poverty level, will I not be able to live here and get a greencard or what?

Please let me know if you have any ideas about this.

Very much appreciated!

Happy thanksgiving.

hi

the petitioner is always the main sponsor and has to file the i864, even if he or she has $0 income. that's why immigration allows a qualifying joint sponsor or co sponsor to cover the beneficiary, so you don't become a public charge

You are fine long as your co-sponsor meets the guideline. makes no matter what your wife makes. It is fine no worries.
