Just curious if this is going to cause more problems for me or not. I initially sent in the I-129F but I had only sent in the I-129 petition and a check (made out to USCIS and not US Department Of Homeland Security). It had been about 2 weeks since I sent it in and figured they pretty much just threw out the case because I was missing so many thing and didn't even make the check out to the right payee. Today I sent in a second petition but verified I had all the right documents and this time sent a check made out to the right department. I was told that they would probably not even contact me since I had no so many mistakes on the first one so I sent out the second on today. Will this cause any issues?

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I never write checks so not sure what to do, I can go to the bank tomorrow and get it cancelled if needed. Will this affect anything with the K1 though? Considering they hardly got any information besides the I-129F form when I sent in the first time I don't see how me sending it in again with the right information could hurt anything. .

It can take up to a month for them to cash the check. You should have waited for that, waited for it to be returned to you, or cancelled it before sending in a new petition.

Scenario no. 1

Hopefully they can fix it once they receive both petitions.. and automatically cancel the 1st one..

Scenario no. 2

If they don't cancel out the first one, AND you get approved, the embassy will detect it and will cause problems with your fiancee's interview.. They will probably delay her because of multiple petitions..

It'd be best you called USCIS to clear things out..

I think you should cancel out your first check.

If they did not received payment, they will cancel your first petition and have the I-129F return to you.

That way, your second petition will be safe. I think that's how it is. May the more experience member help you with this

K1 (I-129F) petition filed in August 2013 (Approved Feb 20th 2014)
13th May 2014: AOS (I-485) & EAD/AP combo card
21st May 2014: NOA 1 and biometric letter
11th June 2014: biometric appointment
13th June 2014: RFE received via mail
16th June 2014: replied to RFE
6th August 2014: EAD Approved, AP still in initial review
12th August 2014: got tracking number for EAD
( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

1. How are they going to cash the check when I made it out to USCIS and not US DEPT OF HOMELAND SECURITY??

2. Could this really get approved? I had only the I-129F form, that means I was missing

  • G-325A and passport style photo (Petitioner)
  • G-325A and passport style photo (Beneficiary)
  • Birth certificate/US Passport (Petitioner)
  • Letter certifying intent to marry (Petitioner and Beneficiary)
  • Proof of having met in person in the past two years

Proof of ongoing relationship

For how much of a pain it is to get the initial approval (From what some users have said in past posts) how could mine even come close to getting approved. I will call them on Monday but I have also heard they sometimes do not even bother sending a RFE or responding back to you in cases like this.

You only made the mistake of sending the check to the wrong Department. You fixed that. A request for evidence is never writing a check. LOL.. Your fine. You might have delayed your NOA1 for a week but thats about it if all else is correct in you Petition. Lets see? The Holidays. You'll get your NOA1 this coming week.

They will not cash both checks and keep the money saying "Sorry Sucker!" It will be returned or Uncashed. The second check made to the Correct Department will be Cashed.

It can happen, especially since they debit your account electronically and destroy the actual check. I once mixed up two checks and my power bill check was sent to, and cashed by my auto loan bank! It was the power company who caught the mistake and called me.

Alright I will be keeping a close on eye on this. Also though it seems like most peoples checks are cashed pretty quickly so it being 2 weeks and still no activity is why I sent another. Thanks for the advice and I will keep a close eye on this.
