Hi,

I applied fir AOS in June 2013 after I got married. My wife did not work and so I had a joint sponsor to help me, and he did!

He filled the i-864 and attached a copy of their tax papers, 1040.

We mailed the papers and then got another RFE in 20 days!! They had a long list of required documents that if not met will mean the denial of this case. Which is why I need your help please!!

Here is the List, and please if some one has been through this let me know what I need and if it is easy to get or cost money. Thank you in advance:

1. Joint sponor must submit A COMPLETE FEDERAL INCOME TAX RETURN submitted for the most recent tax year (2010)....

2. Joint sponsor must submit all supporting documents (W2s, 1099s and all supporting tax schedules) submitted to the IRS for most recent year

3. Proof of citizenship or status

( Then they include his wife.... PS the file jointly file for tax..)

4. For househild member to submit a competed i864-A form

5. Please submit that house hold member was authorized to work in the USA..??!! "she is an american citizen too!!!"

6. For his wife to supply alll tax papers (W2s, 1099, supporting tax schedules) submitted to the IRS for the most recent year.

I don't know y his wife has to get involved?? his income is very good. Does it have to do with the fact that they file jointly for tax? and wasn't the form 1040 sufficient enough as tax documentation?? why do they need to have W2s, 1099 and schedules??! and are these documents easy to process or does it take time to request and have copies of?

Is there a way to not include his wife in the process?

Please I need help. I am lost and I dont know why I got 2 RFEs . is that common when using a joint sponsor?

hi

because he has to separate his own income from his wife's so he has to put his individual income, and his W2s show how much he made on his own, separate from his wife, if not, and his wife's income is included then she needs to file the i864A

he can send a tax transcript of the year 2010

They need a complete copy of tax return. That is ALL forms, schedules, W-2s and/or 1099s, OR use an IRS tax return transcript. They are free.

Proof of citizenship is a copy of US birth certificate, naturalization or biographical page of US passport. If an LPR, then front and back copy of green card.

Was the wife listed on his I-864 as providing income or an I-864A? If not, and he does not want to use her income, then he needs to provide the complete joint tax return or IRS transcript with added W-2 to show his individual income. He can provide a statement that he meets the income requirement for his household size plus the intending immigrant without the need for his wife's income to be used. Make sure he in fact meets the requirement without her income first. If her income is needed, she needs to fill out an I-864A. See the instructions for the I-864 and I-864A.

if she Is mentioned, that means he's including her, if not then he needs to put his individual income and leave her out. of course she is as liable as her husband, she is co sponsoring the beneficiary so the person doesn't become a public charge
