Home Sick, How long did you wait for AOS to be complete?

Hi all,

So I moved to the USA on September 10th, 2013 on my K1 Visa

Filed for AOS AP and EAD November 20th, 2013...And now the wait...

It's my birthday and I am alone because I can't cross to celebrate with my family in Canada. They are literally 30 minutes away from me to add to my frustration.

So my question being,

How long was your timeline from AOS filing to AOS approval?

And did you have any RFEs? If so, what for and how long did it take to have the RFE resolved?

I'm a bit home sick I guess you could say, wondering if anyone out there feels the same.

It usually takes about 60 - 90 days to get your AP/EAD card. AOS approval varies greatly depending on if you get an interview or not. We did not have an interview and it took us almost a year to get my husbands green card.

I would agree with the above poster concerning the EAD that it will take between 60-90 days. Concerning the GC it all depends. Sometimes people have an interview within 4 months, sometimes people receive the "Notice of Potential Interview Waiver" letter and wait another 6 months to make the total a year from filing to getting GC. Some receive the letter of Potential interview waiver and wait a week or 2 to get the GC approved. For me it was about 5 months from filing to GC approval without an interview. But once you get your EAD you are able to travel.

The decision of whether you do or don't get an interview is totally random (50/50). If you get an interview the online case status will say "Testing and Interview" and you will receive a letter telling you when your appt is.

Gee, well I have the worst luck lol...so I'm banking on no interview.

30 minutes away and they live in Canada; what is stopping them from coming to the US and visiting you? Now that you are living in the US they may want to consider travelling to the US rather than you travelling back to Canada. At least your family can visit without too much trouble and a long international flight. If my wife's relatives are granted a tourist visa--slim chance--then we would have to pay around $2500 per person for air travel as they cannot afford that amount of money. So we will always have to travel to see them.

Just trying to put your situation into perspective that even though it sucks you cannot visit your family on your birthday this year, you have more options then we do when it comes to visiting family and friends. You should receive your AP card in about 60 days and the GC in about 4-6 months.

Hang in there as this is a long process, but it is well worth it,

They do visit once a week, but I am missing out on my unversity graduation and my mothers wedding. And being so close and having to deal with an imaginary border is getting old.

I would not do that. I would get all the papers ready in case you DO have an interview and get it on short notice (I have seen people get their notices barely one week before the interview, which is an incredibly short time). But, you only filed 10 days ago, so you should get your biometrics done first and then see what happens to your status. Also you will be able to travel on your AP once it has been approved, which does not take that long (most of the timelines I have seen lately were between 60-70 days for the EAD/AP combo card).

I also agree with the poster above me, you are incredibly lucky that you can see your family that often. Most of us are not that lucky.

As for my personal timeline, my EAD/AP got approved after 65 days, then I got an "Interview Waiver Case" letter after 6 months, and I received my Green Card without an interview after 8 months.

I would not do that. I would get all the papers ready in case you DO have an interview and get it on short notice (I have seen people get their notices barely one week before the interview, which is an incredibly short time). But, you only filed 10 days ago, so you should get your biometrics done first and then see what happens to your status. Also you will be able to travel on your AP once it has been approved, which does not take that long (most of the timelines I have seen lately were between 60-70 days for the EAD/AP combo card).

I have my biometrics on the 18th so I'm happy about that, I agree I am lucky considering some peoples circumstances, it's just crazy that I am missing out on so many things there, but it's worth it. I knew what came with the territory! I meant to say I am banking on having an interview... I definitely have a lot of the paperwork needed, I'm very organized. But I'm almost positive we will he an RFE, does that slow down my AP?

Why did you wait so long to file? We filed about 2 weeks after he crossed over to the US. Although our church wedding was a couple of months away, we had a civil wedding (with some family) within a week so that we could get the immigration paperwork started.

It took about 2 months for the AP/EAD and about 3 months for the green card back in 2010. You should go click over to the immigration timelines at the top of this page and look up your local office to look at local processing times. If there is a family emergency, you may make an Infopass appointment and plead your case and they can offer an emergency AP on the spot.

If my mind serves me correctly though they cannot get an emergency AP just for a graduation or wedding though. It has to be some sort of medical emergency, correct. OP stated that what he is missing out on is his mom's wedding and his graduation.

We were given legal advice from a lawyer, that we decided was a horrible idea.

Basically, I never received my NOA2 for my approval of my fiance visa...He informed us that we need to file for I 824 and get a duplicate - which can take anywhere from 3-6months to receive. BEFORE we can apply for my GC AP and EAD. This seemed stupid and after a month of debating with him, we called USCIS and they informed us to file and then wait for an RFE and not to wait until we receive the duplicate...So basically he was a complete idiot and I believe what he said and now we are 2 months behind on our process. We married September 20th, and I had all my green card packet finished that same day...but was told to wait.

I will never take legal advice again, and learnt my lesson.We aren't even having a real wedding until next September.

We waited because of what someone else told us to do, with a law degree. Clearly it was a mistake, but nothing can be done now.
