I am a service member in south korea and I fell in love with a filipina who is currently getting a divorce from her husband. He is an American contractor. She has a b1/b2 tourist visa and a sofa visa. After her divorce is finalized, will I have to perform all the visa steps from scratch? Apply for fiancé or spouse visa, depending on where we would like to marry, then go about the immigration process. Do that all from scratch, or is there a different route possibly?

She wants to apply for her green card now but I told her to wait because she would be gaining it under false pretenses. Am I wrong here?

Any help will be greatly appreciated.

She can't do anything until her divorce is final. Since she is divorcing her current USC spouse she is not eligible for a green card through him. You cannot petition for her either as a fiance or a spouse until her divorce is final. One thing to remember is they are going to scrutinize her for marrying two USC so close together.
