I-94 is about to expire

Timeline

My husband has a K3 visa and his I-94 will expire at the end of this month. We sent in the paperwork for AOS and EAD already (before the 90 days). Does an expired I-94 matter since he is K3? Do we need a valid I-94 for anything else? Please help.

12/19/06 AOS and EAD applications recieved at Chicago office

12/22/06 file sent to CSC

2/14/07 touched

3/2/07 touched

3/5/07 touched

3/13/07 file sent back to MSC

3/14/07 touched

3/21/07 touched

3/23/07 touched

6/06/07 Interview

6/18/07 Notified through email that card was ordered

6/26/07 Recieved card in the mail TODAY!!!!!!!

EAD

3/20/07 EAD touched

3/22/07 recieved email that card has been ordered.

3/26/07 EAD card recieved in the mail.

Not a problem, you are fine. As with K-1 visas many file AOS paper work long after the I-94 expires.

Is now a US Citizen immigration completed Jan 12, 2012.

As long as you have filed for AOS you don't have anything to worry about. Just give it some time to process. Now that you've gone through the long K-3 or K-1 process this should be pretty easy. At least you have your spouse here and life continues.

Hang in there, an end is in sight.

K3 is a multi entry visa.... if the K3 is now expired then it will make no diffrence if the i-94 has expired... you do not need a unexpired I-94 to leave the USA... you will complete a new I-94 if and when you re-enter the USA using either a K3 or an AP...
