Hello Everyone,

Where do we start? My husband and I have been married for 10 years. Myself and my 2 kids are US Citizens. Here the situation. He has absolutely nothing! I mean "NOTHING"! No status in the US. No pending paperwork and he needs a Green Card (Permanent Residency). We called Immigration, we've visited Immigration to ask question and we cannot seem to get any assistance.

Where do we start? Will this be a difficult process for us? When we do file, how will Immigration view our case? Any assistance will appreciated. We are desperate. Thanks.

There R free consultations with some attys. check your local area.

Go to immigrate2US.net and join that forum

did your hubby arrived by tourist visa or sneaked in?

how and when did he come in , did he come as a minor.

Has/does he work ....Do not let him drive.

You will file I 130 form with a copy of his & your birth & marriage certificate

With money order of $420.00 (call immigration & they will send U I 130 forms)

fill in all questions on forms truthfully and sign,waiting for answer could take

4-12 mths currently.

During this period find a good WAIVER atty, some good ones are on site at I2US

also some has payment plans, the process is costly & lengthy if waivers are equired

but its the only way to get him in status, so start sooner than later, by mailing in the

petition.

If he has a criminal record, he will need a copy of his court records, so the when its

requested at NVC its available, even if it expunged the record is needed.

If all he has is EWI the case is even better, do not use notorios or let anyone file

asylum for him...good luck

Although I highly doubt he entered without inspection (EWI) as Canadians rarely do, I assume this is a simple adjustment of status from a tourist entrance overstay

As long as he entered the US legally and I assume as a Canadian he did then this is a simple AOS. I don't know if I would rush to an attorney to start with because you might get a fear monger who will try to get too much money.
