Immigrating to Canada

I am a Canadian citizen, living in the US as a Permanent Resident (awaiting 10-yr GC approval), married to a US citizen. I will apply for Naturalization next summer.

After I obtain my US citizenship, my US citizen husband and I would like to immigrate to Canada.

Can we apply to Canadian Immigration while we are both living in the US?

Anybody with any information would be greatly appreciated.

Sponsors not residing in Canada must provide evidence that they reside exclusively outside Canada on the date of giving the undertaking and will reside in Canada at the time their sponsored spouse, common-law partner, conjugal partner and/or children become permanent residents of Canada. Evidence that they will reside in Canada may include one or more of the following:

· letter from an employer;

· letter of acceptance to a Canadian educational institution;

· proof of having rented/bought a dwelling in Canada;

· reasonable plans for re-establishing in Canada or severing ties to the other country.

BTW, the average processing time is very short for family sponsored visas to Canada. They take precedence over others (I think). The oldest cases they are working on are from November 2006.

One thing that you might want to be aware of is that Canada has VERY strict laws regarding DUIs. Convictions of DUIs essentially renders someone inadmissable (as an intending immigrant and as a visitor). There is a waiver available but I think there are some pretty strict guidelines around it and how long ago the conviction took place.

And yeah, I've been looking into this because our plan is the same as your plans.

Me and my husband are also planning this in a few years...now if I have a 10-year green card, does it become void after I'm away from the US for a certain time? If we drive over the border to see some friends, will it count as me returning to the US?

If you have a greencard I think the key is "domicile" in the US, so you could be putting that into jeopardy by leaving before you are naturalised and visiting friends probably doesn't count as returning.
