I am in a similar situation. I have been married for three months. I send off a letter requesting to revoke my sponsorship as he has not received his conditional green card yet. I have completed the petition for divorce but have no filed at the moment. He is refusing the leave the residence and due to his temper, I am looking for alternative placement so the papers can be served for a divorce summons. I know many of you have posted to not leave the home, but I ultimately feel I would not be safe. He is verbally abusive and has a very short temper- I feel it would do more harm if I stayed in the home. He has refused to contribute towards bills now although he has been previously (he has quite a bit of money in his accounts from his previous job), so I am paying all of the bills and will continue to do so to not have my credit adversely affected as well as my rental hitory. I just sent off the revocation letter- How long does it take for him to be notified? Also, is he legally allowed to reside here for the entire divorce proceeding after it is revoked? Will I be held financially responsible for him during that time? We do not own any assets together- The rental lease is in my name and he is listed as a guest as they did not want him listed as a tenant because he is not employed, so I am able to remove him at anytime. I made enough money to pay the bills but not much more. I do have 1 loan out. We own no property together and have no children. I am just trying to prepare myself for what I am getting into. Any advice is appreciated.

Once you send the withdrawal request, it could take over a month to receive acknowledgement that it has been received or accepted. Once it is accepted, your husband will not be notified, YOU will. You will receive a letter from USCIS that states they received a request to withdraw the I-864. From my previous experience, I requested a withdrawal of my I-864 and my I-129f. This is what my letter said from USCIS:

Dear (NAME):

On (DATE), you filed a Form I-129F (Petition for Alien Relative) on behalf of your spouse, (SPOUSE NAME). The Form I-129F was approved on (DATE). On (DATE), you filed a form I-864 (Affidavit of Support) on behalf of your spouse which was submitted in conjuction with your spouse's Form I-485 (Application to Register Permanent Residence or Adjust Status). On (DATE), USCIS received a letter from you indicating that you would like to withdraw the petition and affidavit of support that you filed on behalf of (NAME).

USCIS has accepted your withdrawal. The Petition has been withdrawn, and there is no option to appeal. This does not preclude the filing of a new petition, should you choose to file one.

It took me about 6 weeks to get this letter after I mailed my original request to USCIS.

Generally after 30 days living in a residence, it takes a court order to remove someone from the residence. The laws of your state may be different. Calling the cops, pressing a domestic violence claim and getting a protection order can keep him out to. Of course you'll be putting him on the streets, as where else will he be able to go? But then you do say he has quite a bit of money saved. Maybe he was planning to go as soon as the green card arrived, or suspected the marriage was breaking down and withheld helping?

WiscoGirl - hey - any news? What have you done so far in withdrawing the I-864, affadavit of support, with USCIS ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
