Hi All,

I would like to know if my partner, who is an american can file a petition or K1 and lodge our application in one of the embassies here in Thailand? I have a Philippine passport but working here in Thailand. My american boyfriend is also working here in Thailand, we've been working here for couple of months now and we've known each other for more than a year now and decided to live in together and work in the same country, but this is not forever here, We want to move in the US to live happy ever after. :D.Anyways, I started to look up some stuff to fill out and collect to send it to the Lockbox office or Im wondering if we can just send it directly to the Embassy coz it is faster and closer to us here in Bangkok.

Yes, Thailand offers DCF, but DCF is only for married couples - so you'd need to get hitched, then chase down the CR-1 visa.

Google for your embassy to check precise procedures and DCF eligibility (there's usually a minimum residence requirement for the USC - probably 6 months, but you'll need to check).

If you want the K1, your petition needs to go to the correct lockbox in the USA.

The above is correct, DCF is only for the CR-1 spousal visa, not for fiance visas.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The USC must have been a legal resident of Thailand for at least six months to file a DCF case.

Thailand will not allow same sex marriage as far as I know.

I suggest you make sure of what you are attempting to do before you start sending in anything including the fees because there are no refunds. The entire case begins with the U S govts acceptance of the fee. So filling out " some stuff " and sending it in could be a huge mistake.

Are you both working legally in Thailand?

DCF is for USC that is a legal resident of Thailand that wants to get a immigration based visa for their spouse which will result in a green card.

A K 1 is used to bring the fiancée of a USC to the USA for the purpose of marriage within 90 days. You fiancée for example can send the petition from Thailand today.

Where to send the fee is easily found in the instructions and forms.

You mean, my USC partner could send a petition today though were not married yet? we are same sex partner, and we are both legally working here in thailand for 3-4 months already. Should we wait for 3-4 months before filling the K1 here in the Embassy in Bkk? thanks for the extend help though :D

I doubt you know very much about what you are doing here and caution you to proceed only after you truly understand how.

The USC can NOT file for a K 1 visa at the embassy in BKK.

The USC can send petition for K 1 to the proper U S address to begin a K 1 case.

You will have plenty to study and understand about how to become and live as a same sex couple and than where to marry in the USA.

thats why im here coz I dont know very much about this stuff. i am just confused on how to get started, and thanks for your help though, preciate it.
