OK guys I am asking this question on behalf of a friend who is a US born citizen but never went to US after birth.. Just visited last year and NOW that she got married to a US citizen too in Pakistan moved to America 2 months ago..

When she was visiting US in 2012 her dad who was serving in army(lived in US for 3 yrs for his masters /engineering in 1980's and army official visit in 2007 for 2 weeks)he applied for a visit visa to accompany his daughter in 2012 but was refused 214B

Now that she moved to US and they are having a reception ,parents want to visit US and attend the reception...

What are the chances they will get a visa?

The situation

Dad is retired now

have two sons one is 23 working , 20 yrs studying

owns a home

DO you think CO would refuse and ask them to get an immigrant visa instead?

Have you seen approvals of US citizen parents who have been denied before?

214 b means he was denied for having immigrant intent. The chances of him being denied a visitor visa for the same thing is high unless he can prove very strong ties to his country.

For an immigrant visa his daughter would have to petition an I130 for a cr1 visa on his behalf. His daughter would have to be domiciled in the US(living), if she isn't she cannot petition for him.The current wait time for that category is minimum a year start to finish, and most cases in Pakistan have administrative processing after the interview at the consulate, in many cases AP through Islamabad lasts a year or longer. With this type of visa he must move and become a resident of the US, It isn't for visiting.

I agree with you. She is living in the US now . Its been only 2 months since she got married in Pakistan and moved to US .. Reception is end of december ....

I havent seen them issuing a visa to someone with this situation.. I have also heard that US citizens parents visit visa is hard to get cus they are considered as intending immigrants cus they can adjust their status once they are in US on b2

Mother did not apply before..

Most unlikely that a visa could be issued in Pakistan in a month anyway, he has left it too late.

Generally the trend I have noticed about Pakistan immigration office is that they give the visa to the women and not so easily to the men. However it seems now that the father is retired, Few of my relatives similar army backgrounds have been given Visiting Visa to usa without any issues. There is a good possibility they will approve the visa given the proper reason why the parents want to visit. My Uncle was not given the visa right away last year and his wife received hers about a week after the interview. When she got here my uncles visa was also issued. Kind of strange how that worked out but this same scenario has happened to a few of our other friends.

On what basis would they get the status adjusted?

Their daughter is a US born citizen. A citizen can get their parents status adjusted in the US means get a greencard for them... they dont have to wait a yr here in Pakistan through counsular processing.. it takes 6 months and process in easy if they are of visitor visa in the US.. many people do that ..This is same for US citizen spouse .. they dont issue visas to them as they can get their status adjusted fast n easy in states..

thats the reason why i am waiting for my spouse immigrant visa lol . Wish i had visit visa so that i could atleast live with hubby while my status was getting adjusted into a greencard

Right, thing is they can Still apply for green card the time difference is really not that much. They should continue with what they had planned before which was apply for the Visit VISA and see what happens. If your friends dad was employeed they consider that as a stronger tie to return and are more likely to give them the visiting visa.

You have AP in Pakistan, more like 18 months or so I would have thought.

The sad part is her dad was refused when he was employed and serving in army..last yr. he got retired recently and now the chances are slim according to their strong ties to your country..She plans to apply for their GC and they also want to move so I dunno what are the chances with a refusal already

"chance" is used in things that you have no control on the outcome... in this case the outcome is based on the individual. so as far as things go, it all really depends on the case you file and also depending on the interviwing agent. Either case it does not hurt, just file the appilcation see what happens. Worst case scenario they will refuse it and then your friend can file the Green Card sponsorship documents.
