my cousin who is going to be my joint sponsor had filed her taxes jointly with her husband and i kinda skimmed through the tax transcript form IRS sent her and it did not seem to speperate her income from her husband's income. we looked at her w2's and her income alone is enough to support 3 people over 125% of the poverty line. we do not want to use her husband's income as living in the household because he is self employed and it would be too much hastle.

can we just use the tax transcript the IRS sent us even though it states their combined income? or do we have to make a copy of her W2 form. in addition, should we sent the original tax transcript the IRS sent us or should we send a copy of it?

When sending any forms in to them for tax and such, they can indeed be copies as you always want to keep your originals unless asked for specifically by USCIS.NVC, etc.

But as the form was one that was filed jointly, you will want to include the W-2 showing that income they are interested in, in this case your cousin. You can contact the IRS web site to get copies and usually takes about 2 weeks to get, or make copies and send them in. Be sure to include transcripts, and tables as requested. Make sure to sign anything they request to be signed with an original signature, and make sure to put case number on all sheets in the upper right hand corner in case they are separated.

I thought copies of the W2s are not needed if you are submitting an IRS transcript of the tax returns. I thought that only if you are submitting a copy of your own tax forms that you filed then you would need a copy of the W2.

so since my sponsor is married and filed for taxes joinlty with her husband, then she needs to also include a copy of her W2s along with the IRS transript of their joint tax return? is this it?

Yes that is the case:

II. Joint Sponsor’s documents (if required)

If a petitioner’s income does not meet the 125% income requirement, a joint sponsor must complete a Form I-864. Note: The petitioner must also submit a Form I-864.

The Joint Sponsor is required to meet the same qualifications as the petitioner and submit the same documentation noted in I. Petitioner’s documents (listed above) including federal income tax return and income requirements.

Why not use both the cousin and her husband - they are in it together - taking the worst case scenario even though she is only sponsor - because they are married both can be sued for recovery in most states. Since you are trying to split the incomes if you still choose to do so - you will need to provide W-2s to separate her income from his.

Hanster - if the co-sponsors are jointly co-sponsoring then you do not need to submit W-2s (just the IRS transcripts) but if you are splitting their income for his or her portion then you will need to provide W-2s - make sure you calculate it also so you know how you arrived at the figure that meets the criteria. I was just trying to minimize the number of forms that needs to be filled by my cousin and her husband.

I am gonna ask them tonight to fill the I-864-A form for him as a co-sponsor.
