Affidavit of Support and Co sponsor questions.

Recently my I-130 was transerred to the California Service Center, shortly there after I recieved a messege stating they had began processing my case. Here at the end of the year I will be flying to italy to spend some time with my wife, so I want to bring my affadvit of support papers along with me. Here is where it gets tricky. I have spent the last 5 years unemployed, and not filing a tax return. I live with my mother and she is more than happy to co-sponsor and meets all the requirements. Am I going to have problems since I have no tax returns? Or will it be fine since my co-sponsor has everything required?

You as the petitioner need to write a letter that you did not fole taxes as you had employment income less than 9250 USD per year and as per IRS publication 501, you don't have to file taxes if income was less than that.

Yes u need an additional sponsor, question is which

Option A - if u and ur mom live at the same address then u need her a household sponsor. Then she files i864A (remember A) with proof of ur relationship to her (birth certificate)

Option B - if u and ur mom live at separate addresses then she can be used as a joint sponsor and then she files i864 (same as what u file with no tax information)(no proof of relationship required)

remember in both options the additional or the joint sponsor needs to be a US citizen (not sure if gc holder works)

If you are only going for a couple of month like I am to Brazil. I not going to deal with them at all enjoy your time with your love one. Your co sponsor will be the one who has to do most the paperwork. You will first have to pay them before anything will happen. Good luck

Yes, we do live at the same address. She has a small farm that I help her with in exchange for food/rent. She is indeed a us a citizen. So if I attach a letter to my i864 stating what you said above, and my mother fills out the i864a, with her tax return information, then we should be ok? Im afraid they are going to see the length of my unemployed and think Im not capable to support her.

The best option honestly is that both you and your mother sign a completed I-864. The I-864a is for when you combine incomes.

And they don't really care about your income as long as you have a qualified sponsor. But in the end it is up to the consulate officer.
