I-864 - only filed tax returns of the most recent 2 years

Hello everyone,

on the I-864 form part 6 question 13, it says: "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year." However, my husband only filed for each of the two most recent tax years. Are we supposed to NOT checkmark that question?

(We do have a transcript of the most recent tax year to send with the form.)

Part 6 question 14 says: "I have attached photocopies or transcripts of my Federal tax returns for my second and third most recent tax years."

Almost the same question; are we supposed to NOT checkmark that question? We only have a transcript to send with the form for the second most recent tax year, not the third.

(In case someone asks about the third most recent tax year; he wasn't working back then.)

Answer: its say ONLY THE MOST RECENT TAX YEAR so if your husband file the income tax for 2012 and 2011 and theres no 2010 thats fine... they're looking only the MOST RECENT INCOME TAX, and you can still checked the box...

answer: its your OPTIONAL you can checked the box or not..

You can put a line through three and hand-write two above it, or simply check the box anyway. Make sure you include a statement that provides as an explanation as to why you were not legally required file taxes in the year you did not.
