Hi my fiance has a 12 yr old but she won't be traveling with him when approved, do we need to specify who's going to take care of her or have his mom write a letter or should we not mention anything about her, eventually she going to come but after he starts working we will petition her.

Are you petitioning for a K-3 visa? You have posted your inquiry in the K-1 visa process forum.

Read the Department of State (DOS) Nonimmigrant K-1 Fiancé(e) FAQs for more information about children and K-2 visas. List the child where indicated on the I-129F petition, to do otherwise is a misrepresentation of the facts.

You have to list the child as the child will be joining him eventually but you dont need to specify who the child will be left with when he leaves....as for the divorce part i dont think that should be a problem as many people do seperate before filing for a divorce and also considering the time a divorce takes to be processed....for the first part of your question i filed my step children papers with their dads but they will not be coming with him they will be joining us later...they never asked who will ne taking care of them and as to the divorce part...my divorce was finalized in may and i sent in my application in may and my fiance got his visa...good luck
