Hi friends,

We got married on 11/18/2013 and I would like to ask you if I could wait to apply for AOS in January. In other words, what is the time frame between getting married and apply for AOS?

You can start the AOS process as soon as you have collected/amassed all of the requisite applications, documents, money necessary for submission. We submitted our AOS packets a little over 2 weeks after our marriage.

There is no deadline to file or any period of time you need to wait either. As soon as you have your marriage certificate back from the court and you are ready, you can file for AOS.

Congratz on your marriage. File as soon as you can, the sooner you file, the sooner you may get your approval.

Either find a good lawyer to fill and file your forms or really read all the posts and information on all the forms necessary VERY carefully. Any missed documents/information/payment will delay your application.

There is no deadline to file or any period of time you need to wait either. As soon as you have your marriage certificate back from the court and you are ready, you can file for AOS.

We had certified copies the day of the wedding, but we did not file for about 2 months. We were looking for a house which took some time and then my Mother passed away so that took a few weeks. Then I decided I wanted to send in our tax return and had to wait for the IRS to process it before they could send me a transcript. Still managed to file before her I-94 expired.

OP: there are several and I mean several posts on this subject asking if there is a time limit to fie for AOS. A K-1 visa holder MUST get married within 90 days of arrival in the US. Period. Once you do that you have fulfilled the requirements of the K-1 visa. No where does it state that you have to file for AOS. Not filing for AOS means the foreign spouse cannot work, cannot re-enter the US, and is out-of-status. Not a good place to be I would think. SO most K-1 visa holders get married and file for AOS ASAP so they can legally work and re-enter the US.
