hi,

i recently became citizen back in may 2012. i have parents in india, and want to bring them to USA and apply for the green card. They have 10 year visitor visa valid till 2016.

My father was recently diagnosed with lung cancer, so will it create any issues with the green card application.

so the questions:

1. should we apply for green card for them while they are in india?

2. or it is better to get them on visitor visa here, and then apply for green card after 60-90 days once they are in usa

3. will having medical condition create issues with the green card approval? i can show enough funds/assests to show that i can cover his medical expenses?

4. and if they get approved for green card, can i then apply for medical insurance through obamacare, as they cannot be denied with pre-existing conditions?

please advise, this is urgent and thanks in advance for your help.

i would also like to add, that we just got the initial report that father could have lung cancer. he is very healthy, active. we still have to go through many tests to confirm it. so in this scenario, as he already has visitor visa, come to us, we apply for green card. will that work?

generally how much time it takes for the green card approval if they are present in us.

No it is not correct Using a visitors visa to enter the US with intent to adjust status is fraud and the max penalty is a lifetime ban from the US. You have posted your plan on a site monitored by immigration which increases your chances of being caught.

While cancer is not a cause to be denied you may be asked to prove that you can pay for insurance and with cancer as a preexisting condition it WILL be very very expensive.. Also unless your parents are young enough to work 10 years they will never qualify for ss benefits or medicare

This will not be over quickly. You will not enjoy this.

No that is not correct, It is immigration fraud to come to the USA on a tourist visa visa with intent to stay, please stop asking about this as it is a TOS violation to discuss/ advice on illegal immigration.

ON your other questions:

- It will take about a year from filing to interview/ visa

- Him having cancer will not mean a visa denial, but you will need to prove that you can support your parents financially, and due to his health issues, they may want you to show you can pay for his medical care/ pay for health insurance.

- Obama cares does not mean their health insurance will be free/ will be the same price as a healthy younger person. Getting them insurance will be very, very expensive.

You don't need the question deleted now that you understand your wrong though about using a visitors visa. Look into the cost of insurance you may find the best path is the continued use of a visitors visa and many parents are happier with their life long friends than in a strange country,

I suggest you visit the healthcare site for your state or the federal state healthcare site if your state does not have one. Your parent's will be in your household so the cost of the healthcare will be based on your household's income. They CANNOT receive medicare for at least the first five years that they are present in the US. They will not qualify for Medicare unless they work for 10 years and pay into the Medicare system.

Even with health insurance you must remember the co-pays and deductibles will add up. Plan accordingly.
