Entering U.S. After receiving I-130 NOA1

I am a B2 (tourist) visa holder and planning to visit USC husband and his family with our dual citizen son from Japan. We are married in jp for over 2 yrs and my husband recently got his job in the states so we currently live apart. We filed i130 just recent and will get NOA1 by then

My questions are:

Do immigration officers know that I've filed I-130 at POE? (Is it on their system?)

I have b2visa, does it make look skeptical? (I have entered the states w the visa w my husband and son a couple years ago and it was so smooth)

My Japanese brother will come with us (he will be VWP) does it makes skeptical? Should we proceed differently at POE?

I prob get bank statement, employment letter just in case.

I have returning tickets (2wks trip plan) but may extend our stay since my husband needs my help to set up our new apartments etc. after less than 90 days I plan to return to japan and wait for the time to receive NOA2 and proceed the rest.

As everyone else, I'm so worried.

Your advise is greatly appreciated :)

I'm only familiar with entering on the VWP, since my hubby is from the UK, but I'm assuming that you'll be fine considering that you do not currently have two visas, only the B2. I don't believe they can see that you've filed an I-130, but have proof that you have strong ties to Japan ready (employment letter from a manager, mortgage or lease on your home, etc), a return ticket, and answer honestly to their questions, and I don't see a problem. Only provide proof if they ask for it. Don't give them more information than they ask for.

You mentioned you only bought tickets for a 2 week stay but may plan to stay longer ... that may be an issue. If it was a day or two over, that would probably be overlooked, but I'd recommend determining exactly how long you'll be staying and changing your return flight to allow more time in the country without any future problems.

05/20/2014 - IV Fee withdrawn/Shows as PAID/DS-260 Available & Submitted

05/21/2014 - IV Package Received (Scanned on 5/23)

06/26/2014 - CASE COMPLETE!!! (Confirmed by call, AOS changed to N/A)

07/10/2014 - Interview date assigned!!!! (August 19th)

My husband visited twice on his B2 after we filed the I-130. He had no issues at the POE. He had plenty of evidence of ties to prove he would return after a short visit - but none of it was ever requested. I concur that you should have your ticket booked for when you plan to return - or at the very least, tell the officer you have it booked for this date but may extend - but will not stay longer than 90 days. You need to leave before the date that the officer will stamp on your passport.

I have no specific knowledge with regards to your questions, but wanted to share our experience: that it is definitely a possibility that you will be granted entry - my husband was after we filed the I-130.

8/28/2013 Received emails with AOS Invoice and DS 3032

8/28/2013 AOS Fee invoiced online and paid.

8/29/2013 AOS Documents mailed via fed ex overnight

8/29/2013 AOS Fee shows as "Paid"

8/30/2013 AOS documents received by NVC

9/3/2013 NVC substitutes DS 261 for DS 3032
