Hello,

I have a query regarding U.S Domicile. Im a USC petitioning my parents from Pakistan. And after birth im living here so I dont have U.S Domicile. I will be having a joint sponser for completing the I-864 Affidavit of support form. Now is it necessary that I ought to have a Domicile now? Or I can make it later when I reach US with my immigrating parents?

Thanks for your reply. So how much time before my parents immigrate, I should reach US?

And while staying here can I be qualified in the category of 'intent to domicile' and write a letter to the authority that as soon as I reach US I will complete all the conditions of forming a domicile?

You can try for "intent to re-establish domicile" and move with your parents when they get the visa, but it is more difficult, especially as you have no previous history in the USA. Writing a letter won;t be enough though, they will want to see more- such as where will you and your parents live, looking for a job and such.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you Penguin for your reply. So there is a chance that I can "intent to re-establish Domicile".

Well, we do have a place where my parents will be staying in U.S. Its my aunt's place. That is the address i have written in the I-130 form. But she is not an immediate relative. We have a distant relation with her.

And there are like 5 or 6 US visits of mine also. We use to go for summer vacations. Last time I visited US was back in year 2000. I also have my social security number. So will this information be enough for me establishing my point of Domicile?

I doubt that will be enough, though each embassy is different in how much proof they require.

What it comes down to is this: Why are you moving to the USA, and what are you doing to fulfill those plans? For example if you plan on going to college (I don;t know how old you are), enroll and show that as proof. If you have kids, enroll them in school and show that. I assume you will get a job? Start looking now- sign on with job agencies, or if a relative will give you a job, get them to write an offer letter now. Where will you live long term, I assume the aunt will just be for a few weeks? Contact realtors and keep the emails as proof.

Really, the best thing would be for you to visit the USA for a couple of weeks and research the move- look at apartments for lease or sale, go to a couple of job interviews, get a drivers license, maybe a cell phone billed to your aunt's house in your name etc. Show that you are preparing to move asap/

You need to prove that you will be living in the US. This is going to be difficult for you to do as you have never lived here. A letter from the aunt is a good start but you also need proof of your future housing arrangements or that you are looking for permanent arrangements. Ties to the US is what they are looking for.....what can you provide to show you will live in the US?

ok. and no i haven't filed us tax returns as i never did a job in US. I will be using a joint sponser for support.

The US requires US citizens to file tax returns even if nothing is earned in the US.

Not having a job in the US does not excuse you from filing if you had income earned outside the US.
