UK student and US citizen DCF or K1

Hello,

I've lived in the UK most of my life but I was born in the US so I'm a US citizen. I am currently doing A levels in England but I hope to study at uni in the US. I will have been with my boyfriend 3 and a half years when I leave for the states and I hope to bring him with me, we want to get married but we're not sure which is best; get married here in England and apply for a DCF or get married in the US and apply for a K1 visa? Considering I will be a student and we don't want to be apart for a long time which option is best? And is there a chance that either could be denied? Please help!

There is always a chance of denial but with a 3 year relationship, that is slim unless he has criminal convictions or some such.

I would recommend getting married in the UK and filing DCF- it is faster, cheaper, and he can work and travel immediately when arriving in the USA. You will need to prove you intend to re-establish domicile in the USA, but having enrolled in uni is good proof for that.

One issue you may face (either way) is the affadavit of support, ie you need to prove you can financially support him, or have a US co-sponsor to do so.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

So... If you preferred the K1 for some reason, you have the time to file that before you go back so your other half can leave with you. It's more expensive, so I still wouldn't over recommend it, but you have time on your side.

DCF is a much better option. It will be faster and easier for both of you.

Most DCF cases are done within 4 months if there isn't anything to delay the application.

October 4, 2013 Interview *approved*

No. DCF requires the US citizen to have legal residency in the foreign country for at least 6 months prior to filing. (Visiting does not count. It has to be legal residency.)
