Ok thank you so much! What do you mean though just need their info, what info and as oppose to what?

She has to fill out an I-134 but does her parent(s) have to fill a separate in too? And then I take those original documents to my interview, the can't sign, scan and email them?

On a slightly different note.. I have done all my forms and my status on ceac says ready for interview. Do I need to send one of those DS-2001 forms (or anything) to say I'm ready for interview. It doesn't say anywhere on my checklist. I've just done all the DS-160 and DS-260 and got all my documents and booked my medical. That's all it says, but I've seen some people say (recently as well) that they have sent a DS-2001, so I looked up what was.

The cosponsor needs to fill out their own I-134. This needs to be an original signed document that you take with you to the interview. It CANNOT be scanned or emailed, it needs to be original.

Thanks! I think that clears everything up now and makes it clear what we need to do! It's a lot, but we have done a lot and come so far! Just gotta get it done. Thanks so much for your help everyone! Wish us luck and it's really nice to actually get some answers and not feel like we are doing this alone.

To be really simple I guess.. What can we do if her income doesn't meet the requirements? Because it doesn't.. What can we do? This can't just be game over, there has to be a way!

Separating the two issues here which are 1) K1 visa, 2) adjustment of Status

K1 in London

Fiancé does I-134 if she earns 100% of the poverty guidelines for 2 people.

--or--

Get an I 134 filled out by one of her parents who makes 125% of the poverty guidelines for 4 people. (That is assuming the fiancé is fully dependent on her parents. So Dad as sponsor would be meeting requirements for himself, Mom, his daughter plus the immigrant.) Note: your fiancé does NOT need to fill out an I-134 if she doesn't qualify as the sponsor. One form from whomever has the money. It's a LONDON thing. Positive.

Immigrant self-sponsors by bringing proof of his financial assets. A spreadsheet summarizing the source and amount is helpful if invested in various places, as well as bank statements and such for proof. There is no specific amount that qualifies. It is a judgement call by the officer interviewing. A few people have reported the amounts they were approved on. Around $40k is the lowest I recall. That doesn't mean less would be rejected. It means nobody has reported on VJ (that I can remember) a lesser amount. People don't always share those kind of details. A foreign person does not fill out an I-134.

(I was going to outline the I-864 options but can't right now. Maybe later)

Thank you! I am starting to get my head around this now and know what needs to be done. That's great if you could outline the I-1864 (adj of status right?) later. No worries if not but I just wanna arm myself with as much information as I can, now it's starting to make sense. As far as the I-134 goes, I think I'll get them both to fill one out. It can't hurt, I can take them both and if one form is obsolete then so be it. Better than be missing something.

The London K1 instructions are here http://london.usembassy.gov/iv_15.html. The checklist you are reading was cobbled together and is not quite giving you the K1 instructions. London has made changes recently and their website and the form you are looking at haven't been done very well.

Follow the website http://london.usembassy.gov/iv_15.html because that checklist you have is geared more for a spouse visa.

Website says K1 completes the DS-160. That is correct. This was new Oct 7, and followed a Sept 1 change, so you can understand how some of the procedures got garbled as they were changing rapidly. The DS-260 is for spouse visas so don't do it.

See Step 2 on the London website http://london.usembassy.gov/iv_15.html. It says when you have gathered your documents, submit the notification of Applicant Readiness. They say email it, but it's actually an online form submission. And they don't really say where to find the form. They end that paragraph with leftovers from the old instructions when a paper Form DS-2001 was put in the post to the contact address they refer to. I told you they have cobbled together a mess. To find your online notification of readiness form, look in the right column, second paragraph where it says:

"The document checklist Form DS-2001 is no longer in use. Please download this list of required documents. Once you are in possession of all of the documents required in support of your visa application, you are required to notify the Immigrant Visa Unit by email. Read more..... "

If you don't click that Read more..... ", you will not find the form to submit. So click it and go to another page with a link to the form you need at the end of the page. Submit the form so London knows you are ready to receive an interview date.

London accepts self sponsorship for a K-1 visa? to me that seems a bit wrong.

As far as the poverty guidelines for a K-1 officially it is 100%, many embassies want 125%, why? cause how can you meet the 125% requirement in 90 days when you AOS?
Joint sponsors, for K-1? not 100% guarneteed, becasue the I-134 is not an legally enforecable form.
Both of those are up the the consular officers decision.

So you have money? well put it in your Ficancee bank account and she can count it towards her requirements. How much?
for a Spouse it is 3 times the amount needed, for all others it is 5 times the amount needed. So for a Fiancee which one will they use? depends again on the counslar officer.

How many to count in the household? they will go off the number in the Income tax return, so if she lives at home but files her own taxes then it would be 2 (you and her).

It might seem wrong to you, but London accepts joint sponsorship and self sponsorship, and they are very easy going in regards to evidence of financials. They know the K1s have it all ahead of them with the I-864, anyway, so they don't need to be strict for the short-term agreement (which is why they'll also accept assets that are much less than the 3 or 5 x required by the I-864).

What is required for Manila is not the same as for London. Not all consulates have the same procedures and requirements. When preparing for the K-1 interview, one should always research and get specific information for their own consulate and never follow the rules or guide for a different one.
