Hi,

We are in the final stages of putting an AOS application together and have a question about what name I should use when filing out the i-485 as well as the forms for AP and work authorization. We would like to use her married name (same first name + maiden last name for middle name + husband name for last name) when filling out these forms but that is different than what is on her visa and passport which show her maiden name. She has not been back to Mexico yet and therefore has not been able to legally change her name there but from I read it seems it is better to use her new married name. One potential issue with this, when she gets her AP issued in her new (non-maiden) name the name will not match up with her passport and I wonder if that is an issue. Any help or advice would be greatly appreciated. - Duncan

Her legal name, which is her married name. Whatever name you put will be the name they put on the green card.

They will match it up with her maiden name from the marriage certificate you will be sending with the AOS.

Also if you travel with the AP, all you have to do is take the marriage certificate with you so that the airlines or whoever you are traveling with have proof of the name change.

I looked at our marriage certificate and I'm not sure why we did this, but my fiancee's name is listed as her maiden name not married name. I'm wondering if we should go back to the marriage office and see if we can get this changed. Otherwise I won't have a piece of documentation like a marriage certificate that shows her married name. Yeah, then her maiden name is still her legal name if her marriage certificate has that. I know in California, at that point, you have to get a court order to change her name, as the marriage license was the only opportunity to change it, and that opporutnity has passed.
