Hello,

I am married and and have a son. Last year I sponsored my parents and they become permanent residents in 2011. My mother petitioned my under age brother and his petition was approved. Now, my mom needs to fill up I-864 but she does not have any income. Im the only one working in house ( we all live in the same house, and I claimed them on my last tax return as dependents). so

1-should I fill out I-864 or I-864A?

2-does my wife needs to fill out an I-864 as well because we filled jointly(wife does not work).

You're mom is the petitioner so she's the one who should fill up the I-864 and send along with it explanation letter why she didn't file income tax return, example, stating that she is unemployed / no source of income etc. You fill up the I-864A and don't forget to also submit your income tax returns for the most recent 3 years (though what they really require is the 2012 income tax).

I AM NOT 100% sure about this. This is just base on my case before. >> For your 2nd question, since you filed an income tax return jointly with your wife, she should also fill up a I-864A for herself. When my dad was still petitioning me way back 2010, he got a checklist about this. My dad's income is too low so he assigned my brother to do the I-864A. My brother also filed a tax return jointly with his wife but during the very first submission of AOS file, my brother's wife didn't fill up a I-864A for herself resulting to checklist.
