Hi, the last time i posted on here i received valuable advice that has helped enormously. My girlfriend lives in the States and I'm English living in the UK. The original plan was to get a b2 visa to visit her for a while, then go for a k1 visa in 6 months or so. Upon realizing my chances of getting a b2 visa are slim to none, we are now looking seriously at the k1 visa. Because my girlfriend has only been back in the states for 2 months, (because she was in the uk with me for 6 months prior to that) she has only been working for 2 months. She earns enough to sponsor me but how long does she have to have been earning to sponsor me? And because shes a waitress and mainly gets cash tips, how can she prove what she earns? Also, she lives with a friend who earned $24k in the last year who may be willing to co-sponsor. Her friend though, has debts. Will this affect her position to co sponsor or do they go solely off income? Again, all replies and advice will be greatly appreciated.

They go solely off of income, not including debts, so you should be fine there.

I haven't run across anything that mentions how long you have to hold the job (unlike with the UKBA). Was she employed before she got this current job? Some of the items we sent (I'm the USC) included tax returns, several months worth of paystubs, and a letter from my employer. Perhaps she can include tax returns/pay stubs from previous employment with a letter of explanation if she didn't work while in the UK? This might at least support the case that, even though her current employment is relatively fresh, she has a strong history of employment.

Does she claim her tips or report them to her employer? At the end of the year, she should get her W2 and can file for taxes. If she reports her tips, then her tax returns will include that as income. If she can get a letter from her employer, and her employer knows how much she earns in tips, they can include that in the letter.

VISA RECEIVED!!!: November 28th, 2013

Beneficiary Arrived!!!: December 5th, 2013

Married December 22nd, 2013

Filing to POE: 8 months, 1 day

Filed AoS application: April 5th, 2014

Received NOA1 in mail: April 11th, 2014 (no text/email)

Received NOA2 in mail: September 2nd, 2014 (still no text/email)

Separated: September 2015
