I am applying for adjusment of status i came on h2b visa

prior to the experiation of the h2b visa i became merried to a usc

i am would like to know what my current status is h2b is expired and i have yet to complete the adjustment of status process

even though my visa has expired i was merried before that what is my status?

pls help me

Have you actually applied for Adjustment of Status. If you have then I would say that you are "pending adjustment of status", during which time you can apply for an EAD and advanced parole.

You entered legally, you got married, and you have applied for AOS, so you are not "without status" but the adjudication is still "pending".

I would recommend getting legal advice just to be sure what your options are in this scenario.

By the way, congratulations on your marriage!

Actually, I believe you are considered "without status", but you do not accrue any "unlawful presence" while your AOS application is pending.

If your HB1 has expired and you have not yet filled for AOS then you are Out of Status..... once you file for AOS your status will become Pending Adjustment.... and any Out of Status days you will have accrued will be forgiven at AOS interview...

Please remember that if you are out of status for 180 days or more it will trigger a ban on re-entry if you were to leave the USA before your have been approved at AOS... if you have been out of status for 180 days or more then do not leave the USA until you have your greencard in hand... even if you file for AP..
