Hello All,

So after the long journey of K-1 visa we are in the process of starting our AOS journey. I apologize in advanced as you would probably see me asking sooo many questions through out this new journey but as K-1 process we have decided to this on our own with the help and guidance form this awesome website. My questions are as follows.

1) My husband and I are from the Dominican Republic, does he need a copy of his birth certificate or the an original?

2) Does the birth certificate must be within 6 months as it was for the K-1 visa?

3) The birth certificate must be translated, and the person must be certified, is it appropriate to go to a notary public for this? if not, who do we go to?

4) As far as evidence, what have been requested according to USCIS is evidence of eligibility, so is marriage certificate, copy of visa, and arrival/departure from enough? Or do we send pics of wedding and/or other evidence of relationship?

5) For Criminal History, this only pertains to those who have been arrested or convicted in the country?

6) For Police Clearness, is this related to Criminal History? or should we submit the form we submitted at the consulate the day of the interview, Police Records (in Dominican Republic or Papel de Buna Conducta)?

7) Can he travel after filing I-131 or is it not granted he may return if the petition it still pending?

8) I moved right after my husband arrived, we did not inform of an address change USCIS, would this affect us in this process?

9) On the website it specifies that if he did his medical within a year based on K-1 visa he would only need his vaccination records? Is this true?

Now for his work permit ( I know I need so much info)

1) I have heard many people say it is not worth filing due to the length of time, is this true? How long does it take? I live in NJ.

2) Do we qualify for the fee waiver based on k-1 visa? Has anyone received this waiver? (Work Authorization fee waiver)

I thank everyone in advanced for their input this journey could turn very complicated if lock of guidance.

He should have brought with him the original Inextensa Birth Certificate.

2) Does the birth certificate must be within 6 months as it was for the K-1 visa?

This shouldn't be an issue. I don't believe the Birth Certificate expires.

3) The birth certificate must be translated, and the person must be certified, is it appropriate to go to a notary public for this? if not, who do we go to?

Yes they must be certified; I went to a local Notary that does Spanish-English legal documents. I'm sure they're a ton in NJ, because you can find one in any Spanish neighborhood in Philly. I believe I paid $35.

4) As far as evidence, what have been requested according to USCIS is evidence of eligibility, so is marriage certificate, copy of visa, and arrival/departure from enough? Or do we send pics of wedding and/or other evidence of relationship?

Send everything (copies). Then bring with you all the originals "if" or "when" you are requested for an interview. Show evidence of an "ongoing relationship". Even "joint accounts" and "rental/mortgage agreement".

5) For Criminal History, this only pertains to those who have been arrested or convicted in the country?

Correct.

6) For Police Clearness, is this related to Criminal History? or should we submit the form we submitted at the consulate the day of the interview, Police Records (in Dominican Republic or Papel de Buna Conducta)?

Correct. Are they asking for you to submit documents for this? You only submit documents if he has criminal history in the US.

7) Can he travel after filing I-131 or is it not granted he may return if the petition it still pending?

Yes. He can travel once he receives his "Advance Parole Card" in the mail. He must physically have it in-hand.

8) I moved right after my husband arrived, we did not inform of an address change USCIS, would this affect us in this process?

You will need to do this ASAP. By law, I believe it's 30 days. You can do this online. I would do this before I submit the AOS Packet.

9) On the website it specifies that if he did his medical within a year based on K-1 visa he would only need his vaccination records? Is this true?

Yes, it's true. He will not need a new medical within 1 year. However, you will need to see a Civil Surgeon to the Medical Forms filled out. I will send you a AOS Guide through your Inbox.

Now for his work permit ( I know I need so much info)

1) I have heard many people say it is not worth filing due to the length of time, is this true? How long does it take? I live in NJ.

It all depends on how fast you case is processed. It won't hurt to file for it because the cost does not change. Almost everyone files for it because he could get his Work Authorization card 1 month before his actual Green Card; at least he can work legally for a month. It's better than nothing. For example, my wife received her Working Card 4-6wks before her Green Card.

2) Do we qualify for the fee waiver based on k-1 visa? Has anyone received this waiver? (Work Authorization fee waiver)

I have not heard of this so, I cannot answer.

The fees for the I-131 and I-765 (AP and EAD) are waived when filed with a pending I-485. The cost is $1070 with or without them. I suggest you file them all.

Yo do NOT have to get a professional, 'certified' translator. Anyone fluent in both languages can do the translation. Whoever does the translation must add this certification on the translated documents > http://www.visajourney.com/content/translations

I didn't know that since in their instructions they say it must be a professional translator...Have you done this yourself??? Because is a couple of dollars we can save in something else....thanksss

Yes, my husband translated his own birth certificate, as have others. What instructions state you need to hire a professional? The USCIS website does not state that >

Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

Signature_________________________________

Date Typed Name

Address

And from the I-485 instructions >

Translations. Any document submitted to USCIS with information in a foreign language must be accompanied by a full English translation. The translator must certify that the English language translation is complete and accurate, and that he or she is competent to translate from the foreign language into English.

Says nothing about a professional or getting it notarized. It just needs to include that certification, filled out and signed by the person that does the translation.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
