Want a Divorce From A Three Year Absent Foreign Husband

Thank you for the honest response. Just for information, the only communication that we have is international SMS. I do think that just texting is still marriage.

Marriage is what you make it out to be. It takes two people to make it work.

It sounds like you are already seeing someone else (or plan to "accept the new one", but want to start it right by divorcing first). Everyone deserves to be happy. I'm glad you are doing it the right way, ending your current relationship before starting a new one. This is what you're doing right?

Anyhow, go get an annulment. That's the only thing you can do since he refuses to divorce you. Good luck

sorry to hear that sis,di na ba maayos ang relationship both of u?? well ur not they only one hubby is absent in 3years were the same yr ,my hubby last time he was here with me feb 2010 until now he didnt back yet but we already talked about that. coz his job is there in the US , so need more patience im sad coz those yrs its hard situation withöut hubby beside us with our two son's .even our youngest son never meet yet in person only through webcam. but soon we will be together again next yr hopefully, just waiting my papers at NVC to case complete.I hope consul can give me a visa soon just worried im sure consul asking about that why husband not come back yet it almost 3 yrs now but i have a reason why....

i have sis in the other group reading her story about his hubby never get back here yet since 2008.. but they only communication is PHone. .never use internet only phone its a long story for her....i do not know if she is a member here or not yet..

NOV 16 2013 sent nvc checklist document fedex istimate friday will recieve to nvc

nov 25 2013--nvc review our docs. waiting for cc

dec 6 2013 -- nvc email got 2nd checklist but case complete.

dec 13 2013-- got P4

dec 19 and 20-- passed medical

Is it possible that I could go to US to file for a divorce even if I have a pending immigrant visa petition? Or at least apply for a visit visa just to divorce my husband.

Even if you could get to the USA and file for divorce, you'd need to establish residency in the location where the divorce is filed and follow their rules. As you've elsewhere stated you'd like to remarry in the Philippines, this still would not work. A Philippine citizen can get a divorce recognised in the Philippines only if its filed by the foreigner. In other words, he still has to file for the divorce. The second step is you need to get that divorce recognized in the Philippines, which is another long process. This will also be denied if you were the one who filed for the divorce, leaving you stuck back at filing for annulment again.
