I and my wife got married in July 2013,we did not file immediately she got back. She said she wants to use an attorney.the attorney has already started filling forms 130,G325 and G28.I am hoping the attorney will send to USCIS before the first week of December 2013.I have 3 kids,that their names were included in part 3 of form 130,but they are not the kids of my wife(the petitioner a USC),I got this kids with my girl friend who never proceeded with the proposed marriage.she got married to another and left me with the kids,though they are in my sister's custody.I don't also intend to travel along with them so soon to be with my wife in the US,maybe when I migrate and start working.me/my wife could petition for them to join us.

Pls what are my to expect on my situation??I will be attending all interviews in lagos Nigeria.Of what help will the attorney be to our case

1) I haven't heard of a G28 but might be something you are suing since you are using an Attorney.

2) Assuming that everything is ready, you should submit as soon as possible because it is a long journey. I hope your Attorney is not delaying you.

3) Study the guides carefully on this. I did not include any children so I can't speak on this from a personal standpoint. I will say that your plan for them to join later after you've settled in is an astute one. Gowon approves.

4) If you reside in Nigeria then all interviews will be in Lagos, Abuja does not do family based immigration interviews. You can also do your interview in any country (if DOS approves I think) as long as you are a legal resident of that country. Gowons pet peeve, even if you are interviewing outside Nigeria, make sure your Wife has been to Nigeria and has met as many immediate relatives as possible.

5) In my opinion and of those that I respect on VJ, unless you have a complicated case (USC criminal record, etc) then using an Attorney is not necessary. It will not expedite your case and may in fact slow down the process. For example when I received an RFE, it came on a Friday to my house and they signed for my response the following Monday. If I had used an Attorney, I would have had to wait for the Attorney to get the letter, the Attorney contact me, I send the information requested to the Attorney and then he would send it in.

What difference does a day or two make you may ask? It might mean waiting another 30 days for an interview date to be set if you miss the cut off.

I also want to salute your astute writings, it is refreshing.

1) I haven't heard of a G28 but might be something you are suing since you are using an Attorney.

Form G-28 is a Notice of Entry of Appearance as Attorney or Accredited Representative. Only an attorney would use that form.

Gowon,thanks for your contributions. You were right about attorney slowing things down,I agree to that.

I will keep a close watch over process and post when I need help from guys VJ. No! I nor my wife have no criminal case.
