Pregnant due december 31 .Green card still not in hand what can i do cos i have to attend my brothers wedding in the uk in april

Hi vj member's its been a while.

The united states is the most stressful place i have ever lived in my entire life.still trying to adjust however if it wasn't for my husband i would have been on a plane back home asap.Am home sick all the time and adjusting to a place like new England Massachusetts isn't easy.The good news is we are Pregnant and expecting our son Martin Luther king December 31st.Sadly with 3 RFES i still don't have my green card even though i have my work authorization and social security .My brothers getting married in londonand his wedding is in April and i don't want to miss it for anything in the world.IS there anything i can do to speed up the process?.secondly can i travel with my son? he will be about 3 and a half months then.thanks guys.God bless .smile.png

whats AP (1-131)? we applied in june

whats AP (1-131)? we applied in june

If you don't know what it is then I'm guessing you didn't apply. You had the option of submitting the i-131 along with your I-485 and I-765. If you knew about applying for the EAD then I'm surprised you didn't also know about applying for AP. It is free when submitted with the I-485 and allows the applicant to leave and re-enter the US while waiting for the green card. If you had applied, then it would have been written on your EAD "serves as I-512 advance parole".

You can still submit the I-131 for free by including a copy of your NOA1 for the I-485.

Really hope things work out fast for you. Missing a brother or sister's wedding can be sad. If you did not have an overstay prior to AOS, please do apply for AP asap just in case your GC is not approved in time for the wedding.

However, if you had an overstay before AOS, be informed that even if an AP is given, you might be barred from returning to the US and your AOS would be considered abandoned. That said, the indication here (see red above) is that you are willing to abandon your husband and travel to London for a brother's wedding? I ask that because in the even that you travel before your GC is in hand, then your AOS application will be deemed abandoned the moment your flight is out of US air space.

Does your work authorization say on it "Serves as 512-L Advance Parole?" Maybe you applied for AP and didn't realize (if someone else did the forms).

If you have 3 RFEs then you are doing something very wrong and are close to a denial. If you don't have any other help with the forms, why don't you put the latest RFE here so VJ can help you know what to send back. 3 RFEs tells me you are not properly responding to the RFEs with what they want.

You will need a UK visa to go to London, but you may already have that. Good luck.

Here's the easiest thing to do if you failed to apply for Advance Parole in conjunction with your AoS paperwork:-

Call the Infopass line and make an appointment. Take your passport, the NOA for your AoS and your travel documents clearly showing flight details. Ask them to put an I-551 stamp in your passport. This is the temporary version of a "green card" and will allow you re-entry to the US on your return.

When we were at the interview to adjust status, I mentioned that I had to return to the UK for a family matter and, even though I had an AP document, the interviewer suggested putting the stamp in as it would save me worrying about losing the NOA while travelling.

Good luck, have a safe trip and enjoy visiting with family. smile.png

She can't get an I-551 stamp since she hasn't been approved for her green card yet. It is possible to apply for emergency AP though. However there is still plenty of time to apply for and receive the regular AP.

Yes you can travel to London with an approved I-131 but before you travel with I-131, make sure you didn't overstay your visa for 90 days or more before you applied for change of status because you can be denied re-entry if you did. That is why on the approved I-131, there is a bold written statement which says that "holder of this document travels outside USA at his or her own risk"
