Hi

I have been looking on this site for a long time, always so informative... I am over 21 married child of USC... I missed the dream act by a couple of months... My mom sponsored me 7 months ago (f3 category) I'm residing in NY on f2 status... I just recieved a rfe for a dna test I sent the request 2 weeks later and see that they recieved it, it's on rfe response review... I was wondering if I will get the approval right away or will I have to wait... I know the approval only means they confirm the relationship and I have to wait for my PD date to be current.. I'm praying CIR bill passes... My main concern is my son... He's 3, does that mean he'll age out by the time I get my GC? And also I heard approvals take years to happen but mine came in 7 months, does that mean they're speeding things up a little bit?

F2 is the spouse of f1 (student) ok... So further processing meaning I won't know if I'm approved or not until pd is close? Rfe response review will take 10 years?

I'm sorry.... I just re read what you wrote... You said "after the I-130 is approved... Ok, so my son wont age out in 10 years... Does nvc make you wait too?

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

hi,

the wait is at the NVC stage mostly. the i130 can take 5 months or 3 years depending on the times that the service center that your i130 is at. then it will be sent to the NVC around 30 days later, your mom would receive a letter from the NVC stating that your case is there, along with your new case number that starts with the letters of your consulate or embassy in your country where you will have your interview at.

then the case is stored until your PD becomes current

hi

no, not unless you can maintain your F2 status for 10 more years. the only way you can adjust status in the US is if you have been here all the time since you came to the US and up to the interview in 10 years with a valid visa. you cannot be out of status, not even one day

so probably your husband won't be able to maintain an F1 status, meaning he has to keep on studying and immigration has to keep renewing his F1 and your F2 during the next 10 years or whatever time the category takes until your priority date is current.

if not, then you have to wait in your country and go through consular processing. no one of your family can be out of status to benefit from your mom's petition.

Going from F to H is nor uncommon.
