I have been looking on this site for a long time, always so informative... I am over 21 married child of USC... I missed the dream act by a couple of months... My mom sponsored me 7 months ago (f3 category) I'm residing in NY on f2 status... I just recieved a rfe for a dna test I sent the request 2 weeks later and see that they recieved it, it's on rfe response review... I was wondering if I will get the approval right away or will I have to wait... I know the approval only means they confirm the relationship and I have to wait for my PD date to be current.. I'm praying CIR bill passes... My main concern is my son... He's 3, does that mean he'll age out by the time I get my GC? And also I heard approvals take years to happen but mine came in 7 months, does that mean they're speeding things up a little bit?

the wait is 10 years so your son will be your derivative since he will be under 21.

but you cannot adjust status in the country unless both of you are legally in the country for that long all the time, you cannot illegally overstay in the country not by even one day until the priority date is current and up to the interview. if not, you have to return to your country and go through consular processing, and depending on how long you have been illegally in the US, you might have a ban and need to file a waiver and your mom file a hardship letter.

it doesn't matter when the i130 is approved, the wait is the same. 10 + years

Thank you.... I don't plan on overstaying... We will continue going to school until the day comes.... That's why I really hope CIR passes... The backlogs are inhumane
