How does it work when using a co-sponsor to fulfill the 125% over poverty lines when the petitioning sponsor (USC partner) does not have enough to sponsor the beneficiary? Does the petitioning sponsor still have to fill out the I864 affadavitt even though they did no meet the amount they wanted ?

For example: We do not make enough to self sponsor or the USC petitioner to sponsor the beneficiary because they were a student. We want to ask someone to help us and use them as a co-sponsor but does the petitioning sponsor still have to fill out the affadavitt even though they clearly dont make enough to be 125% above poverty lines but the income of the co-sponsor would suffice that amount?

Also what proof did you send to demonstrate that the USC petitioner did not have to file? Do you get a letter from the IRS if so how did you go about that?

You and the co-sponsor should fill out the forms. Even though you can't qualify, you don't want the USCIS to get too confused about who is filing and why.

Actually, I think it's a requirement but I don't have time to research the regulations. In this case it is always better to have both sponsorships with the application. They usually look for a relationship that can be supported by some type of history.
