DCF in Mumbai? (K-1 for US/UK couple)

Hi,



I’m new to this forum so firstly….my apologies.



Here’s my situation:



I’m from the US and my boyfriend of five years is from the UK.



We are currently living and working in Mumbai and plan to move back to the US in early 2015.



I have a few questions:



1. Is it possible to DCF in Mumbai (or Delhi)? If not…is it possible to DCF in London without being there? Otherwise, is the only option applying to the NBC, giving our Indian address, and then eventually down the process they’ll send it here? Does giving my permanent US or his permanent UK address an option?



2. Would it make more sense to get married here and then file for a spousal visa?

Do you know if DCF is possible in Mumbai, or only in Delhi?

My only concern is that the process will take longer than we want to be here (we are planning on leaving January 2015.)

Looks like New Delhi is the only one in India.

It's hard to predict processing times at this stage for applications that are submitted now. You can look at the time for approvals now but these don't necessarily reflect processing times for the people who apply now. It could be longer or it could be shorter. It's a tough call. K-1 is generally faster than CR-1 but has its disadvantages. DCF is a faster option for CR-1 but there are certain requirements. To qualify for DCF generally you both have to reside there for at least 6 months (and you both have to have have legal residency in that country) . You should check the requirements for DCF for whatever country you are thinking of applying in

I spoke to the USCIS in Delhi last week to ask if we can DCF. They told me that even though I have lived and worked in Bangalore since 2009 that does not prove residency in India and she advised me to file our 130 via Chicago lockbox. According to the USCIS website to prove residency I have to show my FRRO and my income tax forms and my pan card (I have all of that) but when I called to ask she said that even with all my documentation it is hard to prove Indian residency and we would risk being denied and losing the $420 so better to file back in the US.

Hi Kat-- would be great to get an update of your status! We are planning on getting married in May, and then filing our I30. We'll be in India until February 2015 (and have been here since January 2013.)

we submitted our i130 last August 9th and just got NOA2 on Feb 12. We are now waiting on the NVC to start the next step and then we will interview in Mumbai.
