This Visa Waiver Program (VWP) link should answer your queries. Spain is one of the countries whose citizens are allowed to visit the U.S. for business or pleasure or transit without the need for a visa provided the visit is for a period of less than 90 days. But your Mom has to be a Spanish citizen or a citizen of one of the countries listed on the VWP link.

Your mom will need to apply for a tourist visa (B2). http://madrid.usembassy.gov/visas/travel/with/procedure.html

An "invitation letter" from you or your USC husband is not required. What your mother needs to show are her strong ties (reasons to return) to Spain.

What is her legal status in Spain.
