Timeline

Hello,

After my GC EAD and AP were received, I now realized we didn't send in my vaccination record (which was completed less than a year ago in Toronto by a licensed physician under visa law) and it was approved with no issues. I also didn't know you had to send a W 2 AND 1099. Will this result in an RFE?

Also, if my AP is approved - when I do cross over into Canada to go home, and then cross back into the USA what do I declare my citizenship as? Clearly I am not a US resident yet, I just don't want to say the wrong thing.Has anyone had any experience with travelling with an AP and how it went?

You'll probably receive an RFE for the tax documents.

You're still a Canadian citizen even after you receive your green card; it's very important that you do not falsely declare yourself to be a US citizen at any point, as that carries a lifetime bar from the US that cannot be waived.

You're still a Canadian citizen even after you receive your green card; it's very important that you do not declare yourself to be a US citizen at any point, as that carries a lifetime bar from the US that cannot be waived.

Okay, does the RFE put a long hold on your case, or is it dependent on how long it takes to send in the proper tax information?

So I always declare myself as Canadian, up until what point? I definitely want to do things properly and by law!

Yes, all processing on your applications ceases once an RFE is issued, and does not resume until USCIS receives a satisfactory response to it.

You will remain Canadian until you take the oath of allegiance and become a US citizen, if you ever choose to do so.

You will remain a Canadian unless you go into an Embassy or consulate, and renounce your citizenship. Canada does not recognize American citizenship, in that they don't make you give up one to hold the other. You will hold Dual citizenship.

So after the N-400 is when I will be considered "Dual Citizen", since that is when naturalization takes place?

Right. I filed from NZ, having lived there nearly 20 years, but am Canadian. Still :)
