medical exam for K-1 holder? not clear if only DS-3025 is enough

Hi,

I come on a K-1 Fiancé Visa from France. We got married. We are now filling for AOS and I am hear to get your help to clarify the grey areas around the medical stuff I have to send.

I am not sure whether:

A) I should see a civil surgeon and send the I-693 form or some pages of it

OR

B) I just send my copy of the DS 3025 and that is it, no I-693 form and no need to see a civil surgeon!

Here is what I have found and read over and over:

=> On the I-485 instructions, p4 it says:

Fiancé(e)s: If you are a K-1 fiancé(e) who had a medical examination withing the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement, not the entire medical report. You may include the vaccination supplement with your Form I-485.

So, I had a medical examination in France within the past year, so I only need to submit a vaccination supplement but it is not clear what a vaccination supplement is? Is it the DS-3025 ? I got a copy when I did my medical examination in France. Is that enough?

=> On the I-693 instructions, p5 it says:

If you were admitted as a K-1 fiancé(e) and you received a medical examination prior to admission then:

1) You are not required to have another medical examination as long as your form I-485 is filed within one year of your overseas medical examination and the medical examination did not reveal a Class A medical condition...

2) Even if a new medical examination is not required, you must still show proff that you complied with the vaccination requirements. If the vaccination record (DS 3025) was not properly completed and included as part of the orignal overseas medical examination report, you will have to have the vaccination report completed by a designated civil surgeon. In this case, you are required to submit the vaccination record and page 1 of Form I-693.

So:

1) What is a Class A medical condition? I looked online and it seems that if I had one I would have not gotten my K-1 anyway so I guess I do not have that since I was approved for my fiancé Visa. Correct?

2) What do they mean by "if the DS 3025 was not properly completed"

On my DS-3025, at the bottom, The Results says:

Vaccine History Incomplete: Applicant may be eligible for blanket waivers because vaccinations not medically appropriate (as indicated above).

The doctor in France told me it was "incomplete" because the Tdap vaccine is never complete since it has to be done every 20 years or so but that everything was good.

I would appreciate if the ones who already went through that (K-1 then AOS) can share their experience on this part.

Thanks a lot.

Michael

Generally speaking, if your DS-3025 says what yours says ("eligible for blanket waiver") you should be FINE without any additional doctor visits.

It's 100% clear you don't need a new medical EXAM, and you should not need a transcription of the vaccines to the I-693 since yours appears to be filled correctly.

The key word being "should", because some foreign civil surgeons don't fill out the forms exactly right, and USCIS finds problems once they review them. If there's any vaccines without a checkbox on your DS-3025 (the ones you don't need should be checked "not age appropriate") or if there are any irregularities, you should get a US civil surgeon to do the transcription.

Personal anecdote: I thought we were fine with my husband's DS-3025 but I tend to be a worrywart, so we went to a civil surgeon for the vaccine transcription anyway -- and as it turns out I'm really glad we did, because not only were there a few shots on his original form that were not checked "not age appropriate" -- there was also an issue with the TDaP because my husband had gotten a TD booster WITHOUT the P, which is the norm in Finland. But the doctor here pulled out a memo from the USCIS and showed us, that the P (Pertussis) is an absolute requirement, and he would have been issued an RFE without it. So we had the new TDaP shot done at the same time as the transcription, and I'm very happy we decided to spend the extra $75 for our peace of mind and ease of filing.

The DS-3025 is the vaccination supplement, and it is all you need to send in as long as it is complete. In your case, since yours says Vaccine History Incomplete, it says you are eligible for a blanket waiver, which is good enough.

We did he same. Ours had the "blanket waiver" checked. The keys whether the form is filled out correctly, not "completely." Out interview is on Tuesday. No RFE.

What some people here are not understanding is the statement in the results that says

MAY BE ELIGIBLE for a blanket waiver. That does not mean everything is complete on your form DS-3025, but it MAY be. You would have to have all required shots and each that you didn't have must be marked with the appropriate reason why a waiver might be given. So you don't have a green light merely by having the blanket waiver result box checked.
