Hi All,


This is my first post. I am in desperate need of some guidance.


I filed my I-130 in May and I-129F in June for my wife who is currently residing in India. So far I have not recieved any updates on the cases. Both the forms have been in initial review stages and everytime I call the help line they say please call after normal processing time.


Can someone please guide me on what is the best way to contact USCIS and get more info? Also how can I move the case forward.


Please see details below:

For I-130:


  • I-130 was filed on May 24th
  • NOA1 received on June 5th

For I-129F:


  • I-129F was filed on June 19th
  • Confirmation received on June 25th with info that case was routed to National Benefits Center
  • NOA1 recieved on June 27th

I just got of the phone with a tier 2.

I had a question about a typographical error in my A number (I am a USC) on the NOA1.

He said that it does not matter since I am a US citizen.

I also asked him about the I-129F i filed for a K3.

He said: " I'll be honest with you, they are not going to honor that"

he also added: "if you don't hear anything by Dec 26 (6 months after I filed the I-129F), call us again"

So, I guess K3 is dead, but I'll still call them the first week of January to check on that.

The problem with the K3 is that the USCIS has a policy to adjudicate the I-130 and the I-129F together. The NVC decided to make it easier on themselves because of this so they close any I-129F that reaches them at the same time or after an I-130. It means less visas for them to do.

So while the K3 is on the books, and some people do occasionally get them, it's very rare.
