Hi everyone i am new here. :) my fiance got his visa in the mail in Germany. But he got one visa that expires a day before his other on he got with it. it said visa shortendeed due to medical examination validation. He did his medical two weeks before his interview letter and they told him that was ok and he was approved. is it normal to get two k-1 visas? Would the second one extend the validitiity of the visa? We are planning for him to move here in the us by december 15th and it would expire until march so we will be ok we are just confused about why he got two visas. Also, can i the petioner pay his $165 fee on ELIAS online as the applicant without any issues? thank you in advance this community has really helped us out alot thorughout our process. :)luv.gifgood.gifwub.png

ok thank you, on the paper that came with the package with the visa in it he needs to pay a $165 fee how would we pay it and can i pay it? <3

As Darnell said, you don't pay it. The $165 immigrant fee does not apply to someone with a K-1, which is a non-immigrant visa.

Exemptions

Children who enter the United States under the Orphan or Hague adoption programs, Iraqi and Afghan special immigrants, returning residents (SB-1s), and those issued K visas, are the only categories exempt from paying the fee.

As Darnell said, you don't pay it. The $165 immigrant fee does not apply to someone with a K-1, which is a non-immigrant visa.

you might want to ask yer fella to

scan both visa pages, and email them to you.

I am betting one of them has been invalidated without prejudice.

Thanx Darnell he is very over whelmed with all the closing of insurance accounts etc so he's worried about this as well as I am I feel it should be ok but we don't want any issues at the POE but I will ask him to scan them this week cause skype is kinda blurry to see it clearly sometimes but from what I could see one was issued 4 days after the first one with different exploration dates no stamp or anything hand written on them just one has typed on it "shortened due to med valididity"

Btw I was confused on the term "without prejudice" but I looked it up and now I better understand so basically the "second visa" waives what was typed on the first visa to make the "one visa" valid for 6 months? Sorry for my confusion now I learned a new term :) ❤️❤️❤️??

that's my assumption.

You can learn more, from studying both visa stamps, scans sent to you via email from yer fella.

- ah - shortened due to medical validity - that's certainly a valid thing, you betcha.

I would use the 2nd issued visa stamp as 'gospel', go by those dates in that visa. I would not look at being 6 months from visa issuance date, but rather, 6 months from medical exam date.

Regardless, I think the 2nd visa stamp is the one he must 'go by', for validity of visa dates and travelling into the USA.

ok thank you so much Darnell you have been very much help I will let him know so he feels more at ease as well. He flies out to me on December 15th so he's preparing everything now and is stressed but once he's here it will be such a relief for both of us. :) ❤️❤️❤️?

(((update)) we FINALLY got an reply from the Frankfurt councelate today. They asked us to send back the passport with the two visas in it since they never stamped anything on the first visa o be canceled. So we already had my fiance's flight to me booked and paid for for him to fly out December 15th thats next sunday already and he is sending the passpot back to them via DHL express so do you guys think it is possible to get the valid visa back ontime before next sunday or would it take two weeks to get it back like the first time? The councelate made the mistake of not caneling the first visa so now we might have to pay again for a new plane ticket this is very frusterating since we can barley afford to... :P

No they said to send it in the mail back to them so they can cancel the first visa. So I'm hoping they send it back to him in the mail before next Sunday but I'm guessing it might be 2 weeks before we get it back. :/

This is what was written in the email...

Dear Mr. Augst,

Reference is made to your inquiry. We appologize for the late response. We have to ask you to forward us your passport with both visas in as soon as possible in order for us to cancel the first visa expiring May 13th, 2014.

We appreciate your cooperation in this matter.
