The difference is that the Republicans did not face the type of obstruction that they are perpetrating themselves. The other difference is that a deal was brokered back in 2005 to avoid that nuclear option - an option raised and the very term coined by, you guessed it, Republicans themselves - and that deal was honored by Democrats. There was a deal brokered earlier this year but Republicans have done nothing to honor it. They continued and actually increased their obstructionism.

The difference, perhaps, is that in 2005 the Republicans knew the writing was on the wall for their majority in the Senate the following year and didn't want to face the blowback.

Dingy Harry, on the other hand, is staking everything on the Senate staying Democrat in 2014, and is willing to risk the fallout if he's wrong to load the court now.

It's a big risk.
