Today I have received my I-128F RFE took them 5 days to send it to me which was nice!!! usually people get them within 15 days..

I'm currently 22 years old and my Fiancee is 17 .... I got a letter stating that

BENEFICIARY IS UNDER 18

Information you provided on your Form I-129F indicates that the Petitioner/beneficary is under age 18. Please identify the in which you intend to celebrate your marriage, and submit a copy of the relevant state's marriage laws permitting a person of the petitioner/beneficary has obtained parental consent in accordance with state law.

State of New Jersey law 37:1-6

A marriage or civil union license shall not be issued to a minor under the age of 18 years, unless the parents or guardian of the minor, if there be any, first certify under their hands and seals, in the presence of two reputable witnesses.

So I have sent the document of parents consent with the original copy translated in English and the Birth certificate showing the parents of my fiancee. I also have sent the law of New Jersey.

I just curious the document of the parents consent was notaries and sealed but the only problem is that there is no two witnesses. I think it not necessary into me and her get married, I will be traveling back on December 30 and I have a document from health department of new jersey so we could all sign and with the two witness. This will give me the ability to make an appointment when she arrives to united states.

My understanding is USCIS they just want to make sure that parents have consent that I could marry her when she arrives??? I have sent the papers already, just need advice...

As we had guessed, it did have to do with the age situation. I would think that you're good for now, but it's really just a guess on my part. Let's see what they say...

02/05/2021 - Oath Ceremony
