EAbbas,

My husband and I will celebrate our 5 year wedding anniversary in August and he has been in the US for 5 months. He is working part-time and going to school full-time. He is not wasting any time trying to make a better life for me and for his family in Pakistan.

My heart goes out to all those still waiting for their visa. Time goes so slowly when you are in AP. I wish you a safe trip in the air and at the airport in Pakistan.

One day your husband will get his interview date and his visa will follow. Enjoy each other and try to make each moment together special.

Hi Carolyn,

I need your help and advice. My husband has been in AP for 22 months. InterviewOct-2012.. He was asked for a new medical in end of august 2013, then they asked for ds230 in October 2013 with two photos, and in Nov 2013 DS260, 2 photos. The case updated a lot in Nov and December. On Jan 15 2015, he got a call to appear for oath and fingerprints, and when he went on Feb 4, he was told everything looks good in our case but still in AP. Since then our case has not updated on its own not even once. It only gets updated when I make a inquiry once a month, or I have congressmen make a inquiry. I am very frustrated and hopeless. I understand a lot of members have waited longer however I think my husband is the only one on this forum who was called for oath and fingerprints and its been 6 months and still no news. I want to file Writ of Mandamus, however I have never spoken to a attorney in my life. What would you recommend at this point? Should we wait 2 more months and see if they ask us for new docs in August/September again?

Hi Sam7076,

I am so sorry the embassy is putting you through this. They have gotten your hopes up many times only to disappoint you and your husband.

Please do not feel hopeless they did something similar to us and now my husband is here with me. I think they were just fed up with me and all my efforts to get him here. They issued the visa with only 30 days to use it. They did not call my husband and ask if he could get here in 30 days they just issued the visa with no warning. So I always advise people to have their airfare ready.

It will cost you thousands of dollars to have an attorney file the Writ of Mandamus. Here in Michigan I could act as my own attorney and after much hard work filed it without an attorney. Remember the Writ will only make them finish your case it will not make them issue the visa. Your visa could be denied which is what happened in our case. We appealed and won and after another 2 years in AP was granted the visa.

It almost seems as if they have forgotten about your case or they are working on some new info they want to investigate. My advise is to write a letter to the ambassador or his assistant...the assistant ambassador is better. Give a detailed account of what is happening with your case and include copies of emails the embassy has sent you. Ask if your file has been misplaced by the embassy because it is taking so long for them to issue the visa. Your letter will be given to a supervisor and I promise you someone will contact you in time. The first time I wrote a letter to the assistant ambassador I got a real letter from the embassy in the mail. It took about 30 days for me to get it. The second time I wrote to him the visa was issued about 2 weeks later.

You write the letter and scan it and send everything to your husband. He will send it to the embassy. Tell him not to let anyone dissourage him or try to talk him out of sending the letter. Just do it and see what happens.

My email address is in my profile. You can write to me and I will help you as best as I can.

Dear All,

I am F2B and My interview was held in Oct 2010 and I was in AP till July 18, sent medical and Ds230 in 2011 too on a call from embassy. In a reply to my status check email they asked me to send DS-260 reciept, fresh medical and photos ASAP(Feb, 2014) so that I can be given appointment for fingerprints and oath, however they did not asked me to send the passport. After sending these documents in Feb, 2014 I got confirmation in reply to my email that they received the document and they will give me appointment for oath and fingerprints after reviewing these documents. Till May 2014, my case got updated many times but not in last couple of months. On 18 July my status changed to "Expiring Soon". Can any of the old geeks tell me about this new development in my case? Did it happen to anyone else too? Is it a ray of hope or they will simply put me in AP again? By the way I have already sent an enquiry email to embassy.

i would say that you either contact NVC or DOS regarding this. usually this status i have noticed with others happens who have been in ap too long. could be just a minor problem but its always good to directly contact them and find out.

btw wat do they ask in f2b interview? if u don't mind sharing

Hi carolynhotstuff,

How do you name a letter on Assistant Ambassador I mean on envelop? If someone really do'nt know the name of him ? How much possibility is there that he will get the letter ? What if someone at the embassy do'nt pass the letter to the consern person ? Will it not be wise if the petitioner send it directly from the USA? and name it on the Ambassador name which is Richard olson now a day?

Your advice will be wise Thank you.

Speaking of WOM as you mentioned your case was permanently denied n how much time they took to deny the case after receiving legal notice or actually filing WOM?

is this denial different from 221g green sheet saying temporary denial? and what happens after they deny? is this case returned back to USCIS? could you give a step by step n processing time on each WOM steps..and what kind of reply you received by US Embassy Islamabad on each steps? what is the total time before filing WOM and after WOM till visa granted? I am in AP for a very very very very long time....so I am thinking to go for WOM ASAP...

Congratulations Raja123.

The person I wrote my last letter to is the Deputy Chief of Mission. His name is Thomas Williams.

Analyst,

When you file a WOM you are suing the government. Copies of the WOM are sent to the Department of State and they send copies of it to the embassy. When the Department of State received my Writ it took about 3 weeks for the embassy to finish our case. We never went to court. After we were denied a couple of weeks later we got the Notice of Intent to Revoke that explained the reasons why we didn't get the visa. We only had 30 days to respond.

Our visa was denied because the embassy made a mistake. They said my husband and I were not legally married because in Pakistan it is against the law for a non-Pakistani Christian to marry a Pakistani Muslim. They had also done a field investigation and said the neighbors did not know we were married. They said we committed visa fraud. Because of the reasons for not getting the visa I had to hire a lawyer to research the marriage laws in Pakistan. If we had gotten married at the court house in Pakistan the embassy would have been right but we got married at my husband's home by a religious official not a court official. Under the law we are legally married. Also my husband's neighbors didn't know we were married because his life would be in danger. He married an American and a Christian. He would have angered a lot of his friends and neighbors so he kept our marriage a secret. We sent copies of the State Departments warning about how dangerous it is for Americans in Pakistan. How Americans are to keep a low profile and that we didn't have a large wedding because they said for Americans to stay away from crowds. We used their own words against them!

Our case was sent back to the embassy were it stayed in AP again for almost 2 years. Along the way I discovered the embassy was making mistakes with our case. When I got the letter from the embassy that was sent to my home in Michigan it said I could sponsor my husband. My income was enough. 6 months later my husband got an email saying we needed a co-sponsor. There were quite a few other mistakes made and we kept all emails from the embassy and the letter from them. There were over 25 updates on our case yet the visa was never issued. They contacted us for fresh documents, medical, I-864, etc and had my husband come in for another interview where there were 3 men from the embassy that interviewed him. They asked him a lot of questions, screamed and shouted at him but he remained calm. They also said your wife loves you a lot we can tell because of the WOM she filed and all the emails she has sent to the embassy but even after that interview they kept our case in AP. Finally I wrote another letter to the Deputy Chief of Mission. Along with the letter we sent copies of emails from the embassy showing mistakes were being made and the original letter the embassy had sent saying I didn't need a co-sponsor. A few weeks later we were surprised with an email from the embassy saying the visa was being issued. That email was sent to me not my husband. I looked on the ceac website and it said issued. When he got the visa it was only good for 30 days. He made it to the USA in 2 weeks.

Analyst has the embassy asked for fresh documents and medical from you recently? They can't issue the visa if your medical/documents are expired. Take your time and think things through before you file your Writ. Filing the Writ brings it's own form of pressure and worry. I was scared to death to file it but I did it anyway.
