New Islamabad AP-Tracker, Part II

Hi Guys and Gals,

First time here but I am long time lurker. Actually my parenst went through this ordeal known as AP. Their interview was done in August 2011 so after almost 30 months in AP, they finally got their visas back in early March. Just to give you an idea, how simple their case was! Both worked and live at the same place for the last 35-40 years ( they are now 67 and 69 years old), no affiliation with any organization or anything like which requires additional scrutiny but USCIS and embassy esp. Islamabad works in mysterious ways!

anyway I am here to ask one basic question and this is very important and I can't seem to find discussion around it on the interweb.

I went to the Oath and fingerprinting at Embassy (since I was in Pakistan already) with my parents and I asked about the timeline of their travel to USA. I was told May 28th (on and before, I guess) for my mother. I guess it depends upon the medical exam date which will be expiring in six month (from Nov 28th). My father has till July to make travel arrangements. Now I have booked them on May 28th, 2014 ( together) and I am flying back to bring them along with me. We are scheduled to be back in USA (Boston as POE) on May 28th at 7 pm and then connecting onward flight to our final destination on the same day with 2 hour layover. Here are my questions:

1) is there any chance of them being not admissible (due to fact of the very last day of their Visa)?

2) Should we plan for more than 2 hour at our POE?

The reason I don't want to change anything at this point:

1) really hard to get time off from work.

2) All the tickets have already been booked, so trying to avoid paying $$$ in change fees.

If this all matters, my mother (who needs to travel on and before May 28th) will be on the wheel chair and I must be present to bring her here.

I had my interviewed on 6th March 2014, More than 30 questions the Co asked me, and by the Grace of almighty i done well, I was having all proofs,



1) But Unfortunately co asked me to show her a proof of 2010 record, as we were talking on Facebook and Facebook was not able to save mesges at that time so i didnt print it out for interview, But Still i have emails of 2010 which my Fiance sent to me, and also three four facebook mesges of 2010. and i have more than 1000 pages of 2011 proofs, more than 1000 of 2012 and also 2013 and 2014, emails and facebooks mesges,



2) The Co said that My petitioner Income is not Sufficient to sponsor me, A Joint Sponsor is needed, While my Fiance Sent an email to US Embassy that her income is more than % 125 of guide line, and the Embassy Replied,


We have review the case record carefully. It is indicated that only the proof of ongoing relationship since 2010 to 2014 between applicant and petitioner, that is you, has been asked for. The joint sponsor is no where there mentioned as a requirement. Please review your paper work again and let us know.




Now My question is.... 1) 5 to 7 emails of 2010, as we meet in Nov 2010, and two to four facebook mesges, Is enough proof of 2010,???


2) Still I need Joint Sponsor Becoz, it was mentioned in the white page 221g INA ?


3) What about my medicals which will be expire in few days,?


4) what about the Civil documents which is almost expired..?

Timeline

Most of the cases which are revoked sent to USCIS for further review NVC will only transfer your file

to USCIS. NVC never makes any decision or review. My K-1 was revoked as well it was sent back to NVC

& NVC transferred it to USCIS, it may likely take from 1-3 months to review your case, My k-1 petition was

reaffirmed and was sent back within 2 weeks, USCIS can ask you for more evidences if needed you will have 1 month

of time to respond them back.

They most likely sent it back for non bona-fide relationship. At the interview they gave my husband back all of the evidence saying that they had enough. So even if NVC reviews it, they will come to the same conclusion. NVC doesn't refute what the embassy is saying and they have it noted that USCIS requested my petition back, so it will just pass through NVC to USCIS. I will have to wait for NOIR and send back the RFE and wait for reaffirmation.

That is what they did to us also, saying not convince of a genuine relationship, more evidence needed and when we personally

submitted 12 additional pounds they complained it was too much and they "don't have time to read all that." :rolleyes:

NVC does not review it, USCIS will review it and decide to revoke or send it again to the embassy with request to approve.

It can go back and forth if the embassy refuses to approve and the agencies play ping pong ball with our petitions.

Address your issues in the NOID/NOIR if you get one, sometimes they send it back to the embassy without a NOID/NOIR.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

1) I would not book that close.

2) 3-4 is better

I would rather change it than start all over. Too much of a chance to take.

What if the flight gets canceled for some reason. Things happen.

You can download all your Facebook data from inside your account settings.

Since it's November 2010 you met, the amount should be enough, check the downloadable FB data though.

I would send them a copy of their request for a joint sponsor on the 221g because they said to review your paper and to let them now.

You have to ask them about the medical and documents.

  1. Click 851562_161099900744997_1185658894_n.gif at the top right of any Facebook page and select Settings
  2. Click on "Download a copy of your Facebook data"
  3. Click Start My Archive
Because this download contains your Timeline information, you should keep it secure and be careful when storing, sending or uploading it to any other services.
Learn more about what info is included in your download. If you don't have a Facebook account, you can make a data access request.

They returned all the evidence to my husband at the interview so I doubt USCIS will send it back without NOIR and RFE. The CO told my husband he didn't need it that there was enough evidence already. They lie and play with our lives. It's absolutely heinous.

you are taking a big chance coming on the final day. If flights are delayed or cancelled or they miss the flight they will have to start over from the beginning. Not a chance I would ever take. If it were me I'd spend the money and move the flight earlier. Why risk it????????

You can download all your Facebook data from inside your account settings.
