hello, Im going to fill out the I 134 for my fiance, my father will be the co-sponsor. I have been a student for the past 4+ years and have not worked so im a dud $$wise. Would I still have to submit tax returns, even though I have not filled out taxes from not working? I have no idea what to do.

Also, my father owns his home, would it be a good idea for him to include it as his other monetary resources? What about a vehicle? This part of the process is really intimidating to me I hope it works out! thank you to anyone who can help! :)

If the income level is above what is required 125% of poverty level then there is no need to include other assets on I- 134. This was accepted at interview for me. I put none in the area involving assets. So you never filed a tax return?

Some general facts on the I-134

  • It is not a requirement for the K visa, even though it is often used, hence why some consulates don't use it.
  • When it is used, it is used in part to determine if the applicant will or won't become a public charge.
  • Other documentation outside of what is required on the I-134 is often required.
  • When the I-134 is used, it is often used in conjunction with other evidence i.e. pay stubs etc. to assist a conof in determining if the applicant will or won't become a public charge.
  • There is no Joint Sponsor with the I-134, only a sponsor. It is not like the I-864 where a joint sponsor may be used, or the sponsor can use household member income to meet the shortfall on the sponsors I-864. This is shown quite clearly from Manila Consulate where confusion is rampant amongst members about their non acceptance of a Joint Sponsor for the K visa. If the petitioner doesn't meet the poverty guidelines (either 100 or 125% depending on the consulate), one can use a family member (close friend in some cases) to be the sponsor, even though a conof may or may not still require the petitioner to submit their own I-134. This does not mean that a joint sponsor has been used in the other person.

Question about I134. I will fill this form out, hopefully, by mid jan. My income for 2006 will be around 90K.

In my case would this be all I would have to indicate on the affadavit? I could leave my savings, 401s and all that off the record?

And then what sort of back up would I need? Just my W2? Do I have to submit tax returns for the past 3 years?

I have no real estate, just money buried and I would rather leave that undisclosed at this point.
