I 212 is for the deportation...have U done interview yet? your consulate will decide

what waivers u need after investigating all inadmissabilities....if its just deportation

no I 601 is required.....an I 212 is easier to to get approved but your lawyer should

know . NO I think it matters not what country U R from the process is simliar timelines

unless U were from a MENA country and goes into long AP...Its not an overnite thing.

Be sure the atty has done successful waivers in the past Lone 212 can take 2-12 mths

Odd that you were deported with adjustment in the process, ICE do not usually do that, in fact I thought there was an Executive order to that effect.

being Muslim does not equal AP. Being from a high fraud country makes the chances of AP higher, no matter the religion.

Why CR1 and not K1? Isnt there a short cut since I got the NOA? I never said I was a Muslim but what does it matter from where you are? Isn't being a human being enough? We're all made from our Creator? And HE is colorless.

So it is odd? Is there away that I've been denied of my lawful rights?

If ICE didn't deported me I would have. How would my consulate investigate that? My old lawyer said he was waiting for the approval from UCSIS so we could start the process but since October we have been waiting 3 months and nothing. Maybe in my case it's different? Read my earlier post @boiler. What is a MENA country and AP? This's new lawyer is major in this with over 60 years of hard earn experiences in a successful way.

should know, yes everyone is human but U the 1st one that believe your country takes

precedence over Columbia remember ? said your lawyer told U this... with an atty I

am amazed that he does not inform U of procedures & timelines.You will/wife have to

show Y U should be allowed back, hardships she would suffer without you and the

decision is discretionary NO guarantees...regardless what states its filed, what country

U R from or if U all know senators, the decision is on DOS...don't get frustrated when

seeking info...this make take up to 24 months, so chill bro ...atty maybe too old for biz if

he been in 50 yrs uscis constantly amending the rules, 3 months and no info???

Ok. I understand you clearly. But the problem is my so cold former hot shot lawyer just pulled my leg now and kept me waiting. But i have confidence in the new 1. Positivity will be required so i will be sticking onto that. But thanks anyways the so cald hardship is not the I-212 right. Maybe if my new lawyer apply the original spousal application and get the answer that the i-212 is required will this mean that she does or not considering the hardship?

Thus was my clue.

I indeed got a timeline before i got deported. If i havent been deported i would my GC already.

I indeed got a timeline before i got deported. If i havent been deported i would my GC already.

I mean I got a timeframe which took up to 6 months. That is what my former lawyer told me. He was right. But I got deported if i wasnt been deported i would already have my Greencard in hand.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

An individual who is not a USC nor living in the US has no rights whatsoever to obtain a visa nor a waiver. Your creator (not mine), in spite of his (or her) omnipotence, is apparently unable to produce or fabricate a visa, or a waiver....instead, you will just have to rely upon mere, 'colorless' human beings. People are not deported from my country for having an overdue library book....usually they are deported for having violated one or more laws of my country...something even your creator cannot justify (or can he...or she?)....

Adjudicating an I-212 does not depend on some nebulous hardships...the focus is more on what transgressions you did, along with other factors....
