A husband has been deported after overstaying Visa waiver Programme

Hi People,

I overstayed my visa waiver by 4.5 months and after being held in a correctional facility i got deported back to europe. But after 60 days i got married, had a blast of a marriage. 2 lawyers told me that that is the way to do it and in my honesty i believed them. I got a 10 year ban cause of the deportation. I filed all my papers and i got a receipt and an appointment for my biometrics. My question is here what to do now? My lawyer is already busy but i need some additional information. Like how long for me to return?

Please do advice and all help is welcome and appreciated to the highest level.

10 year ban is a 10 year ban I'm afraid. There is no waiver for it.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding

Wife file I 130 with payment copy of both Bc & mc certs

tell the truth u overstayed and was deported on form, when

uscis check out and approved U with a bonafide marriage,

they'll send this to NVC, who will request copies of case,

police record from your country, certified copies of immigration

case, and whatever else they want, make sure they recieve

everything , your atty should know this, there's no telling how

long it will be at NVC as U may get extra check Condors, Ncic etc

they then forward your file to consulate in your country with

an interview date * Note if U have no criminal records that's a

good thing. Your wife will file waivers I212 & i601 after U interview

if the CO approves u to file for these waivers, which u make sure your

atty does properly, The CO will give U a 221G denying visa , but ok to

file waiver...people who have claimed USC, killed someone, Drug

dealers , not showed up for immigration court have no chance of waivers

your wife can for your waiver, the process is long & expensive but doable

make sure U have atty explain everything and keep a copy of all papers

that goes to uscis... battle but y can fight best wishes.....so its uscis...nvc...dos...uscis

Ps: re-reading I see U already got 1st noa (petition approvalsl)

Hi People,

My wife allready filed the i-130 already its in pending. Well u see my major concern is how long will this all take?

All my papers; birthcertificate, criminal records, history. All everything is there at the attorney. I just spoke to the lawyer and they will just file the i-130 and for the waiver they will show extreme hardship. Thats what the lawyer told me. I guess they work different in Florida or my lawyer has a shortcut. The problem is when they put me in the correctional facility at ICE they got the receipt for the application and an appointment for my biometrics. Understand?.

I know i need to get a second opinion but all the receipts and papers is at my attorneys office.

Its been almost 3 years you guys have been strugling. Are we gonna face the same issue? What happened? Your input will be more then welcome.

ppl should.nt give legal advise dashing

has to be informed or say "I think" it cant

No i was locked in a correctional facility holding me for deportation. The appointment came through the mail when i was getting ready for deportion. Will this 2 be a help for me?

Big question is why were you initially stopped and held. Did you do something illegal that may complicate things ? It is one thing to get a hardship waiver for an overstay another to get the waiver for some illegal acts.

This will not be over quickly. You will not enjoy this.

Approval receipts...but I see u get it while with ICE. If U have no felonies in any counry, then

that's good, Y/how did U come in contact with ICE? Its good U have an atty, however the process

is not overnite, after your interview date all hardships to your wife (not U0 and evidences, remember

its a discretionary process, so make sure U have copies of everything the atty sends out or U give

to him as evidence....no atty can speed up the process , but they will have to do your brief.

currently waiver packets R adjudicated 5-8 mths alhough USCIS reports its 4 mths,
