filed i-130 - do I have to wait?

Hi guys, I'm new here. I (US citizen) married my wife (Japanese national) in August, and I filed the i-130 and received a 797C, notice of action. It is just the receipt however.

I'm wondering if I can file the things I need for the CR-1 now? Or do I have to wait until I get an approval? Please advise - thank you!

You cannot file anything related to the CR-1 until the I-130 is approved. A CR-1 visa application cannot be processed without the underlying I-130. I would begin now to read and educate myself on the NVC process, but wait to actually do anything until you get the I-130 approval notice.

File what things? When you sent in I-130 there were required documents alongf with your evidence of a bonafide relationship you were to send all with I-130. Is that what you mean?

Did you file DCF or mail to Chicago lockbox?

I sent the I-130 application and check to the Chicago lockbox and they sent me a receipt. I was just curious if I could start applying for G-325 form while the I-130 is being processed but I guess not.

Nope. Only after your I-130 is approved you can move on to next step. Till then all you can do is prepare everything you need for NVC and wait for USCIS to get rid off all the backlogs.

Oooooh........ Ok, the G-325A is not an application for anything. It's a biographical form which needs to be submitted along with the I-130. Also to be submitted with the I-130 is proof that you're married (marriage certificate) and evidence that the marriage is bona fide. They also need proof that you are a US citizen. All of this should have been submitted along with the I-130..

At this point, one of two things will happen:

1. The I-130 is denied for lack of evidence and missing information, aka you have to start from scratch, or,

2. You can hope that the USCIS will send you a request for evidence (RFE) to request that you submit all the missing forms.

There is a tab on the top of this page that says "Guides" - Click it and then click on "CR-1 / IR-1 visa and I-130 Petition Guide."

I filed an I-130 back in Jan.2013 you were supposed to send the G-325A one for you and one for your wife

with your I-130 application. The G-325 is your Biographic information along with all your supporting documents.

Here is the list of things you were supposed to send with your I-130

I-130 application

G-325A for both of you

2 passport sized photos of both of you 2x2 in size

Your Birth Certificate to prove you are a U.S. Citizen

Certified copy of your marriage certificate

Affidavits from friends and family proving you have a bona fied relationship

Travel documents such as a copy of your plane tickets demonstrating petitioners trip to meet and marry the beneficiary

Photographs of you 2 together out and about and on your wedding day

Chats, letters, and phone records between petitioner and beneficiary

Any receipts from packages or money you may have sent your wife

__________________________________________________________________________________________________________________

All of this documentation was supposed to be sent with your I-130 application.

maybe you will get an RFE request for evidence if you get that it's not a rejection

at that point you can send in all your supporting documents if you don't receive a

denial letter for lack of evidence. The list I sent you of what you were supposed

to send in with your I-130 petition I know about those things because I have an

immigration lawyer who helped me with all my documents and then put my intire

petition together and mailed it for me.

I'm sorry if I come across as harsh... but why did you not even look into this before sending everything off? It's so easy to find out what to do and now you've probably wasted $420 and a lot of months before they even get back to you to deny it.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

You will have to wait for an RFE or NOID to be able to send anything else in, if allowed. Otherwise you will be outright denied and you can send in the required documents and evidence again. Please read the guides here, and the I-130 instructions very carefully and make sure to have all the documents necessary for either case. :)

They won't reject you... just send you an RFE. Then you just send in the necessary things.

Yes you are being harsh on him. He's new and maybe didn't know about this. It's not like the official USCIS website spells it all out.

No, he won't lose the $420. They'll just ask him to send in the missing stuff by way of an RFE.
